The Contracting Authority requires the supply of a Commercial Off The Shelf (COTS) software application to perform vessel stability analysis and determination of gross tonnage and the provision of training and support services. The Contracting Authority has twice previously published an RFT for this requirement neither of which resulted in an award being made: • RFT ID 3880189 Request for Tender for the provision of Vessel Stability Software to the Department of Transport published 3 July 2024 • RFT ID 3220188 Request for Tender for the provision of Vessel Stability Software to the Department of Transport published 11 March 2024 Following feedback from the market, and extensive internal engagement, the Contracting Authority is now publishing a new competition which facilitates the successful Tenderer to incorporate its Software Licence Agreement in accordance with the Software and Services Contract included at Appendix 5 of this RFT. Tenderers are kindly asked to take note of this summary of the process detailed in the tender documents: • The Software and Services Contract itself, included at Appendix 5, has been significantly simplified from that published previously. • Tenderers are required to indicate, in the TRD, whether or not the delivery of the Goods and provision of the Services requires the Contracting Authority to incorporate their Software Licence Agreement in accordance with the Goods and Services Contract included at Appendix 5 of this RFT and, if so, to confirm that that their Software Licence Agreement (if applicable) is consistent with the documents listed with this RFT, the Goods and Services Contract included at Appendix 5 and the Tenderer’s Tender. • It is a matter for Tenderers, that offer a standardised form of Software Licence Agreement for the delivery of the required software application, to consider any amendment(s) to such a standardised form of Software Licence Agreement so that their proposed Software Licence Agreement is consistent with the RFT, the Goods and Services Contract included at Appendix 5 of this RFT and their Tender. • Tenderers are not required to submit their Software Licence Agreement (if applicable) with their Tender. • If a Tenderer indicates that it does not require the incorporation of their Software Licence Agreement then, in that event, they shall be precluded from subsequently requiring the incorporation of same at a later stage of the Competition. • The Tender which has been awarded the highest total marks available pursuant to the Qualitative Requirements Table will be deemed to be the Highest-Ranked Tender. • If the Highest-Ranked Tenderer requires the incorporation of a Software Licence Agreement then they shall be required to submit same so that the Contracting Authority may verify that it is consistent with this RFT, the Goods and Services Contract included at Appendix 5 of this RFT and the Tenderer’s Tender. • If the Contracting Authority is satisfied that the Software Licence Agreement provided by the Highest-Ranked Tenderer is consistent with this RFT, the Goods and Services Contract included at Appendix 5 of this RFT and the Tenderer’s Tender then the Highest-Ranked Tender shall be deemed to be the MEAT.
