TII intends to award a MetroLink Programme Delivery Partner Support Services Contract, with specific services to be performed set out by task orders. The Programme Delivery Partner appointed to perform the Contract will provide capability and capacity to integrate with and support the MetroLink Directorate in the co-ordination and management of the pre- and post-contract stages of the MetroLink Project. The Programme Delivery Partner will manage various contracts procured by TII through providing services relating to, inter alia, safety, project management, site supervision and contract administration. The Programme Delivery Partner Support Services Contract will be awarded in accordance with the provisions of the European Union (Award of Contracts by Utility Undertakings) Regulations 2016 (S.I. 286/2016). As the estimated value of this contract is equal to or greater than EUR 250 million, any economic operators participating in this tender process are under an obligation to notify the contracting authority of all foreign financial contributions as defined in Article 28(1), point (b) of Regulation (EU) 2022/2560 on foreign subsidies distorting the internal market. If no such financial contributions have been received, the economic operator must instead submit a declaration to the contracting authority that it has not received such financial contributions from countries outside the EU.

Description of the procurement

MetroLink will provide a high speed, high capacity, high frequency, modern and efficient public transport service for passengers travelling along the Swords/Airport to City Centre corridor in Dublin, which will be capable of integration with other modes of public transport. TII intends to award a MetroLink Programme Delivery Partner Support Services Contract, with specific services to be performed set out by task orders. The Programme Delivery Partner appointed to perform the Contract will provide capability and capacity to integrate with and support the MetroLink Directorate in the co-ordination and management of the pre- and post-contract stages of the MetroLink Project.

The Programme Delivery Partner will manage various contracts procured by TII through providing services relating to, inter alia, safety, project management, site supervision and contract administration.

TII intends to separately procure multiple public contracts which the appointed Programme Delivery Partner shall provide support services for to ensure the successful delivery of the MetroLink Programme, including, but not limited to: enabling works and services contracts, M401/402 main civils infrastructure contracts, and the M500 public passenger transport design, build, finance, operate and maintain contract.

The Programme Delivery Partner Support Services Contract will be awarded in accordance with the provisions of the European Union (Award of Contracts by Utility Undertakings) Regulations 2016 (S.I. 286/2016).

TII may adopt the procedure detailed in Regulation 49(1)(f) of the European Union (Award of Contracts by Utility Undertakings) Regulations 2016 to award new services consisting of the repetition of similar services entrusted to the successful Tenderer under this tender process including for the further development of the MetroLink project, such as revised or additional routes or additional statutory planning procedures, subject to ongoing need, budget availability, satisfactory performance by the successful Tenderer and approval of all relevant authorities and for similar services required from the successful Tenderer in excess of the estimated value and/or duration of the Programme Delivery Partner Contract.

Variants will not be accepted. Tenderers must submit a tender submission that fully complies with the requirements set out in the tender documents. Any variants or alternative proposal will be rejected.

TII will not be liable in any way for any participant’s costs arising in connection with participating in the competition, irrespective of the outcome of the competition, or if the competition is cancelled or postponed for any reason.

TII has the right at any time and without notice to:

i. terminate the tender process (or part of it);
ii. change the tender process’s basis or procedures;
iii. procure the contract by other means;
iv. reject any, or all, of the tenders;
v. not furnish a tenderer with additional information or to do any combination of the foregoing or anything else deemed appropriate. In no instance will TII be required to give any reason for any alteration or termination of the process.

The award of contract will be subject to all necessary and relevant approvals.
