Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU) The NSSO have commenced a procurement competition for a new MSP provider and have passed the PQQ stage and are about to issue the RFT to 4 shortlisted vendors in early Q12026. Due to competing priorities within the NSSO, and also as a result of the timing of the Wave 2.1 go live in Q4 of 2025, it would not have been possible to issue the RFT, select a new provider and transition that provider into service in 2025. The go live plan for Wave 2.2 is being finalised and will be complete in Q12026. When the timing of Wave 2.2 go-live is clarified, it is the intention to interleave the transition and go-live of the new MSP service to minimise risk to the FMSS programme and the continued service to those already live on the system. To facilitate the continued operation of the MSP for FMSS Waves 1 and 2.1, and to ensure that there is no gap in service at the expiry of the existing Agreement, and to allow sufficient time to run the new competition, including evaluation, award of contract and to allow for a transition period from the incumbent provider (if required), the NSSO now wish to extend the Agreement for the provision of the MSP services under the existing Agreement by up to 12 months to the end of December 2026. A change of contractor at this stage, for a contract of 12 months duration would impose a significant additional cost on the NSSO and in addition to significant risk that other issues would emerge as the system is used and the other contactor would have to address and as such go beyond providing a managed service, as well as the issue of significant inconvenience arising from delays and disruption for the NSSOโs services to on boarded PSBs if a new contractor had to be sourced and on boarded at this time. In summary, a change of contractor would be completely impractical at this stage due to the increased risks and costs involved. As such, it would not be a rational decision to make this change at this critical point in time.
