Consequently, the CA's FOI Officer may decide to disclose the Candidate/Tenderer submission or part thereof. If the Candidate/Tenderer explicitly states which part of its submission it would not like to see disclosed and specifies the reason for same, the CA will take such request into consideration if it receives an FOI request. However, the CA's FOI Officer will ultimately decide whether the requested information should be submitted (or not as the case may be) under the FOI Acts. It is not sufficient to include a general statement that the totality of the submission is confidential or commercially sensitive, for the CA to take the information into consideration specific part of the submission have to be highlighted and reasons have to be given for each specified part. B. The successful tenderer is precluded to enter into any other contracts related to the student accommodation and ancillary facilities the subject matter of this competition. If the successful tenderer has formally executed a contract with the CA with regard to the said student accommodation and ancillary facilities, then its tender shall be removed from this competition. Information barriers are not accepted. C. If the Candidate/Tenderer is a joint venture, then all its members shall be jointly and severally liable. D. The Contracting Authority may terminate this competition (or any part thereof), change the basis of and the procedures for the tendering process, at any time, or procure the project by alternative means if it appears that the project can thereby be more advantageously procured. The most economically advantageous tender or any tender will not automatically be accepted and the contracting authority reserves the right not to award a contract under this competition.
