Legal, economic, financial and technical information Conditions for participation
Suitability to pursue the professional activity:
Applicants are required, as part of their Expression of Interest, to provide confirmation of the following:
a) Acceptance of Irish Law as governing any contract awarded.
b) Acceptance of the jurisdiction of Irish Courts.
c) A statement that no record exists against
the bidder of successful court actions involving fraud or other major breaches of the Companies Act in Ireland, or similar law in any other jurisdiction.
d) A statement that the applicant has fulfilled its obligations relating to the payment of taxes and social security contributions in Ireland or any other state in which the applicant is located.
e) A statement that the applicant has within the last year complied with all appropriate labour legislation relevant to pay and pension.
f) A statement that the applicant will during the course of the contract term for this project comply with all applicable and appropriate labour legislation relevant to pay and pension.
Economic and financial standing:
Candidates must demonstrate that they have adequate financial capacity to deliver the project. Applicants are required, as part of their Expression of Interest, to provide the following:
a) Audited financial statements for the applicants proposed contracting entity for the most recent 3 financial years. Such financial statements must include at a minimum
(i) profit & loss account / income statement
(ii) balance sheet
(iii) cash flow statement if applicable &
(iv) the detailed explanatory notes associated with balances within the financial statements.
If audited financial statements are not available for the most recent financial year, up to date management accounts including appropriate explanatory notes should be submitted.
b) Confirmation, in the form of a letter from the relevant surety/bond provider that the applicant will be in a position to raise the bonds associated with the contract from a bank/surety which meets any of the following criteria:
(i) a long term credit rating of not less than A (Standard & Poors) or A2 (Moodys Investors Services, Inc.)
(ii) a financial institution holding a Banking Licence in Ireland issued under Section 9 of the Central Bank Act 1971 (Ireland)
(iii) a financial institution listed in the IFSRA list of credit institutions authorised to carry on banking business in Ireland under EU Directive 2006/48/EEC and holding a long term debt rating of not less than A (Standard & Poors) or A2 (Moodys Investors Services, Inc.
(iii) a financial institution listed in the IFSRA list of credit institutions authorised to carry on banking business in Ireland under EU Directive 2006/48/EEC and holding a long term debt rating of not less than A (Standard & Poors) or A2 (Moodys Investors Services, Inc.
Confirmation of ability to provide the necessary bonds associated with the contract will be a pass/fail criteria in the evaluation of Expressions of Interest
c) Evidence of current levels of insurance cover. Such evidence may be in the form of either
(c -i) copies of the relevant insurance certificates for each of the insured risks, or
(c-ii) letter from insurance broker providing details of insurance cover in respect of the following risks
(i) Employers Liability
(ii) Public Liability
(iii) Professional Indemnity
(iv) Products Liability
(v) Motor Insurance
(vi) Travel Insurance (if applicable).
d) Evidence of ability to secure funding
The award of this contract will be subject to the approval of the Finance Providers. Consequently, ESB reserves the right to seek additional commercial safeguards in the event that this is a requirement set down by the Finance Providers.
