1) There are genuine reasons for extreme urgency โ timescale to complete, the availability of contractors and materials is of fundamental concern in that a failure to act immediately will effectively mean the project would have to be cancelled;
2) The situation is not attributable to the contracting authority โ The funding is not available to the contracting authority through any other means;
3) It is not feasible to comply with the usual timescales in the 2016 Regulations โ In the current market even if the time was available the requirements of the market, availability of materials and execution of the project render the timelines unachievable;
4) The events that have led to the need for extreme urgency were unforeseeable โ funding stream could not have been foreseen or provision made to facilitate its expenditure in the absence of the option proposed.
