I slutet av det andra året av kontraktsgenomförandet blev det uppenbart att konsumtionen av tjänsterna enligt kontraktet är högre än ursprungligen planerat. Därför beslutades att höja kontraktets ursprungliga tak för att säkerställa kontinuitet i tjänsteutbudet till dess att det löper ut i slutet av februari 2026. Skälen till beslutet som togs var att byte av entreprenör inte bara skulle dubblera kostnaden för att driva nätet (två entreprenörer som tillhandahåller samma tjänst parallellt). Förhandlat förfarande utan meddelande (enligt punkt 11.1 ei bilaga I FR) följdes för att ändra avtalet. Möjligheten att använda detta alternativ angavs under det ursprungliga förfarandet som resulterade i kontraktstilldelningen.

No final do segundo ano de execução do contrato, tornou-se evidente que o consumo dos serviços abrangidos pelo contrato é superior ao inicialmente previsto. Assim, foi decidido aumentar o limite máximo original do contrato, a fim de garantir a continuidade da prestação do serviço até ao seu termo no final de fevereiro de 2026. As razões para a decisão tomada foram que a mudança de contratante não só duplicaria o custo de funcionamento da rede (dois contratantes prestando o mesmo serviço em paralelo). Foi seguido um procedimento de negociação sem aviso prévio (nos termos do ponto 11, n.º 1, alínea e), do anexo I do Regulamento Financeiro) para alterar o contrato. A possibilidade de utilização desta opção foi indicada durante o procedimento inicial que resultou na adjudicação do contrato.

В края на втората година от изпълнението на договора стана ясно, че потреблението на услугите по договора е по-високо от първоначално предвиденото. Поради това беше решено да се увеличи първоначалният таван на договора, за да се осигури непрекъснатост на предоставянето на услугата до изтичането му в края на февруари 2026 г. Причините за взетото решение бяха, че смяната на изпълнителя не само ще дублира разходите за експлоатация на мрежата (двама изпълнители, предоставящи една и съща услуга паралелно). Беше последвана процедура на договаряне без обявление (съгласно точка 11, параграф 1, буква д) от приложение I FR) с цел изменение на договора. Възможността за използване на тази опция беше посочена по време на първоначалната процедура, която завърши с възлагането на договора.

Στο τέλος του δεύτερου έτους εκτέλεσης της σύμβασης κατέστη προφανές ότι η κατανάλωση των υπηρεσιών στο πλαίσιο της σύμβασης είναι υψηλότερη από την αρχικά προβλεπόμενη. Ως εκ τούτου, αποφασίστηκε να αυξηθεί το αρχικό ανώτατο όριο της σύμβασης προκειμένου να διασφαλιστεί η συνέχεια της παροχής υπηρεσιών μέχρι τη λήξη της στο τέλος Φεβρουαρίου 2026. Οι λόγοι για την απόφαση που ελήφθη ήταν ότι η αλλαγή του αναδόχου δεν θα διπλασιάσει μόνο το κόστος λειτουργίας του δικτύου (δύο εργολάβοι παρέχουν την ίδια υπηρεσία παράλληλα). At the end of the second year of the contract implementation it became obvious that the consumption of the services under the contract is higher than originally envisaged. Therefore, it was decided to increase the contract's original ceiling in order to ensure continuity of the service provision until its expiry in the end of February 2026. The reasons for the decision taken were that changing the contractor would not only duplicate cost of running the network (two contractors providing the same service in parallel). Negotiated procedure without a notice (as per point 11(1)(e) of Annex I FR) was followed in order to amend the contract. Possibility of using this option was indicated during the original procedure which resulted with the contract award.

Otrā līguma izpildes gada beigās kļuva skaidrs, ka līgumā paredzēto pakalpojumu patēriņš ir lielāks nekā sākotnēji bija paredzēts. Tāpēc tika nolemts palielināt līguma sākotnējos griestus, lai nodrošinātu pakalpojuma sniegšanas nepārtrauktību līdz tā termiņa beigām 2026. gada februāra beigās. Lēmuma pamatā bija tas, ka darbuzņēmēja maiņa ne tikai dublēs tīkla ekspluatācijas izmaksas. (divi līgumslēdzēji paralēli sniedz vienu un to pašu pakalpojumu). Lai grozītu līgumu, tika izmantota sarunu procedūra bez brīdinājuma (saskaņā ar FR I pielikuma 11. punkta 1. apakšpunkta e) apakšpunktu). Iespēja izmantot šo iespēju tika norādīta sākotnējās procedūras laikā, kuras rezultātā tika piešķirts līgums.

Alla fine del secondo anno di attuazione del contratto è risultato evidente che il consumo dei servizi previsti dal contratto era superiore a quanto inizialmente previsto. Si è quindi deciso di aumentare il massimale originario del contratto al fine di garantire la continuità della fornitura del servizio fino alla sua scadenza, prevista per fine febbraio 2026. La motivazione della decisione è stata che il cambiamento del contraente non avrebbe solo duplicato i costi di gestione della rete (due contraenti che forniscono lo stesso servizio in parallelo). Per modificare il contratto è stata seguita una procedura negoziata senza preavviso (ai sensi del punto 11, paragrafo 1, lettera e), dell'allegato I del RF). La possibilità di avvalersi di tale opzione era stata indicata nel corso della procedura originaria sfociata nell'aggiudicazione dell'appalto.

Par conséquent, il a été décidé d'augmenter le plafond initial du contrat afin d'assurer la continuité de la fourniture de services jusqu'à son expiration fin février 2026. Les raisons de la décision prise étaient que le changement de contractant ne ferait pas seulement double emploi avec les coûts d'exploitation du réseau. (deux entrepreneurs fournissant le même service en parallèle). Une procédure négociée sans préavis (conformément au point 11, paragraphe 1, point e), de l'annexe I du RF) a été suivie afin de modifier le contrat. Por lo tanto, se decidió aumentar el límite original del contrato para garantizar la continuidad de la prestación del servicio hasta su vencimiento a finales de febrero de 2026. Seetõttu otsustati suurendada lepingu esialgset ülemmäära, et tagada teenuse osutamise järjepidevus kuni selle kehtivuse lõppemiseni 2026. aasta veebruari lõpus. Na konci druhého roku realizace smlouvy se ukázalo, že spotřeba služeb na základě smlouvy je vyšší, než se původně předpokládalo. Proto bylo rozhodnuto o navýšení původního stropu smlouvy, aby byla zajištěna kontinuita poskytování služby až do jejího vypršení na konci února 2026. Důvodem tohoto rozhodnutí bylo, že změna dodavatele by nejen zdvojila náklady na provoz sítě (dva dodavatelé poskytující stejnou službu paralelně). Za účelem změny smlouvy bylo dodrženo vyjednávací řízení bez oznámení (podle bodu 11 odst. 1 písm. e) přílohy I FR). Možnost využití této možnosti byla naznačena při původním řízení, které vyústilo v zadání zakázky.

Na konci druhého roka implementácie zmluvy sa ukázalo, že spotreba služieb na základe zmluvy je vyššia, ako sa pôvodne predpokladalo. Preto sa rozhodlo o zvýšení pôvodného stropu zmluvy, aby sa zabezpečila kontinuita poskytovania služby až do skončenia jej platnosti koncom februára 2026. Dôvodom tohto rozhodnutia bolo, že zmena dodávateľa by nielen zdvojnásobila náklady na prevádzku siete. (dvaja dodávatelia poskytujúci rovnakú službu súbežne). S cieľom zmeniť zmluvu sa dodržalo rokovacie konanie bez oznámenia (podľa bodu 11 ods. 1 písm. e) prílohy I FR). Ob koncu drugega leta izvajanja pogodbe je postalo očitno, da je poraba storitev po pogodbi višja od prvotno predvidene. Zato je bilo odločeno, da se zviša prvotna zgornja meja pogodbe, da se zagotovi neprekinjeno zagotavljanje storitev do njenega izteka konec februarja 2026. Razlogi za sprejeto odločitev so bili, da zamenjava izvajalca ne bi le podvojila stroškov vodenja omrežja, ampak (dva izvajalca, ki isto storitev opravljata vzporedno). Za spremembo pogodbe je bil uporabljen postopek s pogajanji brez obvestila (v skladu s točko 11(1)(e) Priloge I FR). Pod koniec drugiego roku realizacji umowy okazało się, że spożycie usług objętych umową jest wyższe niż pierwotnie zakładano. W związku z tym zdecydowano się na podwyższenie pierwotnego pułapu umowy w celu zapewnienia ciągłości świadczenia usług do czasu jej wygaśnięcia z końcem lutego 2026 roku. Decyzję uzasadniono tym, że zmiana wykonawcy nie tylko zdubluje koszty funkcjonowania sieci (dwóch wykonawców świadczących tę samą usługę równolegle). W celu zmiany umowy zastosowano procedurę negocjacyjną bez ogłoszenia (zgodnie z pkt 11 ust. 1 lit. e) załącznika I FR). Możliwość skorzystania z tej możliwości została wskazana w trakcie pierwotnego postępowania zakończonego udzieleniem zamówienia.

Derfor blev det besluttet at forhøje kontraktens oprindelige loft for at sikre kontinuitet i serviceydelsen indtil dens udløb i slutningen af ​​februar 2026. La sfârșitul celui de-al doilea an de implementare a contractului a devenit evident că consumul de servicii din contract este mai mare decât se preconizase inițial. Prin urmare, s-a decis majorarea plafonului inițial al contractului pentru a asigura continuitatea prestării serviciului până la expirarea acestuia la sfârșitul lunii februarie 2026. Motivele pentru decizia luată au fost că schimbarea contractantului nu ar duplica doar costul de funcționare a rețelei. (doi contractori care prestează același serviciu în paralel). Pentru modificarea contractului a fost urmată o procedură de negociere fără preaviz (conform punctului 11 alineatul (1) litera (e) din anexa I FR). Posibilitatea de a utiliza această opțiune a fost indicată în timpul procedurii inițiale care a rezultat odată cu atribuirea contractului.

Aan het einde van het tweede jaar van de contractuitvoering werd het duidelijk dat het verbruik van de diensten onder het contract hoger is dan oorspronkelijk voorzien. Daarom werd besloten om het oorspronkelijke plafond van het contract te verhogen om de continuïteit van de dienstverlening te garanderen tot de afloop ervan eind februari 2026. De redenen voor het genomen besluit waren dat het veranderen van de contractant niet alleen de kosten voor het beheer van het netwerk zou dupliceren (twee contractanten die parallel dezelfde dienst verlenen). Om het contract te wijzigen werd een onderhandelingsprocedure zonder voorafgaande kennisgeving gevolgd (overeenkomstig punt 11, lid 1, onder e) van bijlage I FR). Tijdens de oorspronkelijke procedure die tot de gunning van het contract heeft geleid, werd de mogelijkheid aangegeven om van deze mogelijkheid gebruik te maken.
