Therefore, interested parties should register their interest on this website in order to obtain all relevant documentation including any supplementary information which may be issued by the contracting authority in respect of this competition. Registration on eTenders is free of charge. The contracting authority will not accept responsibility for information relayed (or not relayed) via third parties. โ€” This is the sole call for competition for this supply. โ€” The contracting authority will not be responsible for any costs, charges or expenses incurred by tenderers in respect of this competition. โ€” Should tenderers wish any of the information supplied by them not to be disclosed because of its sensitivity, they should, when providing the information, identify it and specify the reasons for its sensitivity. The contracting authority will take this into consideration if it receives a request for disclosure, and may consult with the tenderer, but may decide to disclose the information despite that tenderer's view. It is not sufficient to include a general statement that all the information is confidential or commercially sensitive. โ€” Without prejudice to the principle of equal treatment, the contracting authority is not obliged to engage in a clarification process in respect of missing or incomplete information. Therefore, tenderers are advised to ensure that they return FULLY COMPLETED tenders in order to avoid the risk of elimination from the competition. โ€” The establishment of the framework agreement will be subject to the approval of the competent authorities. โ€” It will be a condition for admittance to the framework agreement that tenderers and their sub-contractors (if any) produce a valid tax clearance certificate from the Irish Revenue Commissioners and that they retain a fully valid certificate throughout the lifetime of the framework. โ€” If for any reason it is not possible to conclude the framework agreement with the designated successful tenderer emerging from this competitive process, or if having concluded the framework agreement the contracting authority decides to terminate that agreement, the contracting authority reserves the right to admit the next highest scoring tenderer to the framework agreement on the basis of the same terms and as tendered by that party, at any time during the tender validity period. This shall be without prejudice to the right of the contracting authority to cancel this competitive process and/or initiate a new contract award procedure at its sole discretion. โ€”No form of exclusivity or volume guarantee will be granted to the framework operator by the contracting authority for supplies and that the contracting authority will at all times be entitled to enter into other contracts and agreements with other suppliers for the provision of any or all supplies which are the same as or similar to the supplies covered by the framework agreement. In the event of the latter the contracting authority shall observe all applicable public procurement rules and shall not afford any advantage to the framework operator. โ€” At its absolute discretion, the contracting authority may elect to terminate this procurement process and the framework agreement at any time. โ€” HRI reserves the right during the currency of the Framework Agreement to add further locations/accounts to the Framework by approaching the existing Framework holder.
