The contract consists of the expansion and upgrade of the
existing Osberstown waste water and sludge treatment
facility from a population equivalent of 80 000 to 130 000
while maintaining the existing operations and treatment
standards.
The Contracting Authority has determined their
requirements in respect of the treatment process and
general site layout. The Contractor will be required to
assume design responsibility for the Contracting Authority's
selected solution, complete the design, and then construct
and commission the works. The Contractor will be
required to assume responsibility for the operation and
maintenance of the treatment facility, from time of
mobilisation on site, while construction works are ongoing,
and during a 12 month proving test after completion of
construction of all Sections. Substantial Completion will
not be certified until after the completion of the 12 month
proving test.

Information and formalities necessary for evaluating requirements are met:

(1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, or not being wound-up, have not granted a trust deed, and are not subject of a petition presented for sequestration of their estate, have not a receiver, manager or administrator appointed and are not otherwise apparently insolvent.

(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected tp participate in this procurement process.

(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.

(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.

(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade resister.

(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.

(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.

Economic and financial standing:

Information and formalities necessary for evaluating if requirements are met:

(1) All candidates will be required to provide a reference from their bank.

(2) All candidates will be required to provide evidence of relevant professional risk indemnity insurance.

(3) All candidates will be required to provide a statement, covering the 3 previous financial years including the overall turnover of the candidate and the turnover in respect of the activities which are of a similar type to the subject matter of this notice.

(4) All candidates will be required to provide statements of accounts or extracts from those accounts relating to their business.

The Candidate is required to submit details of any issue arising since the date of the most recent accounts, and which requires disclosure in accordance with International Accounting Standard (IAS) 10. In the event of a potential Contract Award, the Financial & Economic Standing of the Tenderer, with the Most Economically Advantageous Tender, will be the subject of a due diligence check. If the Tenderer's Financial & Economic Standing at that time does not meet the minimum criteria, then the Tenderer will not be awarded the Contract.

Minimum level(s) of standards:

The Candidates average turnover, over the previous three years, is required to be at least EUR 8 000 000. The Candidate's Economic & Financial Standing as assessed by the information contained in the audited accounts and balance sheets over the previous three years is required to be sufficiently robust, to permit the Candidate to undertake the contract, if awarded, without undue financial risk.

Candidates relying on the Financial & Economic Standing of a Parent Company or other body, will be required to provide an undertaking, signed by the Guarantor and without qualification, that a Parent Body Guarantee, in the required wording, will be available, in the event that a Candidate is successful in the Procurement Competition, is required to be submitted with the Request to Participate. The required wording is as per the Standard Form associated with the Public Works Contract Forms.

Contract execution
Deposits and guarantees required:

Candidates who prequalify on the basis of the Financial & Economic Standing of a Parent Company or other body, will be required to provide a Parent Body Guarantee for the performance of the contract. The wording of the Guarantee will be the Standard Wording associated with the Public Works Contract Forms. An undertaking, signed by the Guarantor and without qualification, that a Parent Body Guarantee, in the required wording, will be available, in the event that a Candidate is successful in the Procurement Competition, is required to be submitted with the Request to Participate.

In the event that a contract is awarded, the successful Tenderer will be required to provide a Performance Bond, in the Standard Wording associated with the Public Works Contract Forms, in advance of the creation of the Contract. The amount of the Performance Bond will be 12.5% of the initial Contract Sum up to certification of Substantial Completion of the Works, and for a further 90 days thereafter.

Main financing conditions and payment arrangements and/or reference to the relevant provisions governing them:

The Terms of Payment will be in accordance with the terms contained in the Public Works Contract for Civil Engineering Works Designed by the Contractor. A retention percentage and a minimum amount will apply to the interim payments.

Legal form to be taken by the group of economic operators to whom the contract is to be awarded:

The Contract is to be signed by a single legal entity, or by a grouping of legal entities, who will be jointly and severally liable for the performance of the contract.

Other particular conditions:

The Conditions of Contract will be the Public Works Contract for Civil Engineering Works Designed by the Contractor.
