Tender Documents are to be clearly marked ‘Operation and Management of Civic Amenity Centres – Service Tender’ and placed in the relevant Tender Box at the Reception, Limerick County Council, County Hall, Dooradoyle, Limerick. Tenders must be returned to Limerick County Council by 16:00 hours; Friday, 1.6.2012. Late tender documents will not be considered and will be returned unopened to the respective tenderer. All tenderers are fully responsible for the safe and timely delivery of any tender documents to the designated address, The tenderer shall provide a current C2 Certificate or tax clearance certificate, The successful service operator shall be required to keep Limerick County Council indemnified against all actions, costs, claims and demands howsoever arising by virtue of the performance by it of its contractual obligations hereunder and shall submit to Limerick County Council, and maintain throughout the duration of the contract and for a 6 year period afterwards public and employers liability insurance to the levels shown above and shall have Limerick County Council’s interest noted on the public liability policy. It is a condition for the award of this contract that the successful service operator shall produce evidence of such cover prior to the service contract award. All sub contractors engaged by the successful Service Operator shall also have an adequate level of insurance cover, With regard to the Transfer of Undertakings (Protection of Employment) Regulations (TUPE Regulations); the contract is to be undertaken in accordance with the Laws of the Land and, as such, the TUPE Regulations would apply where appropriate. In this regard, it might be noted that the TUPE Regulations, protects employees’ terms and conditions of employment when a business is transferred from one owner to another. Employees of the previous owner when the business changes hand automatically become employees of the new employer on the same terms and conditions. It’s as if their employment contracts had originally been made with the new employer. Both old and new employers are required to inform and consult employees affected directly or indirectly by the transfer. Since both old and new employers are required to consult employees affected by the transfer, it would be unlikely that all potential new employers could enter such discussions and that such discussions would therefore have to take place after the tender procedure. Again, rates of pay etc. would be considered commercially sensitive and therefore, any new prospective employer would have to carry this risk. Contract execution
Deposits and guarantees required:
Employers liability insurance to the value of 12.7 EUR million in respect of anyone occurrence but unlimited during the contract and with a specific indemnity to Limerick County Council,
Public liability insurance to the value of 6.35 EUR million in respect of anyone occurrence but unlimited during the contract and with a specific indemnity to Limerick County Council. The successful service operator shall provide evidence of financial and economic standing as follows:
a) A statement of turnover for the last 3 financial years;
b) A statement from the Tenderer’s bankers that the tenderer is financially capable of undertaking a service contract of this size at this time.
Other particular conditions:
The contract for the operation of these Recycling Centres will be based on the requirements outlined in the current Waste Management Legislation and the requirements of the EPA’s certificates of registration,
The successful service operator shall be deemed to have satisfied themselves before submitting its tender in regard to the effects of extraneous factors including economic climate, in determining the amounts of recyclable and other waste stream(s) being received and handled at the Civic Amenity Centres. All hazardous wastes are to be transferred in accordance with the Waste Management (movement of hazardous waste) Regulations 1998 and the Waste Management (Transfrontier Shipment of Waste) Regulations 2006,
