TG4 is the National Irish language Channel based in Baile na hAbhann, Co Galway, Ireland and broadcasts for 24 hours a day, 7 days a week. The TG4 website offers programme based information and micro sites. The TG4 Player offers live and on demand archive material. Irish is the working language at TG4.
TG4 wishes to engage a supplier(s) to provide.
Lot 1: commercial airtime sales, sponsorship sales and product placement sales for the channel.
Lot 2: web advertising sales including all applications and platforms.
For a three year period from 2013-2015. TG4 will have the option to extend each of the Contracts for a further two years at its absolute discretion. Remuneration is on a commission only basis and is payable when pre-agreed sales targets are met. Applicants are requested to submit an EOI in respect of one or more lots. A separate EOI should be submitted in respect of each Lot. TUPE will apply to this tender.
1.2 Notice to companies submitting EOIs.
Three hard copies of the Expression of Interest response should be delivered before 12:00 noon on 26.7.2012 to the following address:

Envelopes should be labelled with the lot number and the address of the tendering organisation should be clearly stated on the outside of the envelope. A covering letter signed by an authorised company representative should accompany the response. Applicants are responsible for ensuring that their response is delivered to the correct address and by the required date and time. Responses received after the stated time will not be accepted, they will be returned unopened to the applicant. Applicants are requested to make their own arrangements to obtain proof of delivery.
E-mailed copies of the submission will not be accepted.

Conditions for participation
Suitability to pursue the professional activity:

(1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.

(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.

(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.

(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.

(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.

(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.

(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.

(8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law or of the relevant State in which the candidate is established

(9) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law or of the relevant State in which the economic operator is established.

(1) All candidates will be required to provide a reference from their bank.

(2) All candidates will be required to provide evidence of relevant professional risk indemnity insurance.

(3) All candidates will be required to provide a statement, covering the 3 previous financial years including the overall turnover of the candidate and the turnover in respect of the activities which are of a similar type to the subject matter of this notice.

(4) All candidates will be required to provide statements of accounts or extracts from those accounts relating to their business.

2.1.3 Financial and economic standing/capacity

TG4 wish to engage with an organisation that is financially sound. TG4 requires evidence of the applicant’s sound financial and economic standing. Proof must be furnished by way of an appropriate financial profile for the last three years and consist of -.

(i) In the case of corporate entities, independently audited accounts

(ii) In the case of sole traders or practitioners, a reference from the tenderer's bank

If, for any valid reason, the tenderer is unable to provide the evidence requested, they may prove their financial and economic standing by any other means that TG4 considers appropriate. Alternatively, an applicant may declare that they have the requisite financial standing and need only provide evidence of same if they are short-listed.

If an applicant is shortlisted and is unable to provide evidence of financial standing, that applicant will be disqualified.
