Kerry Local Authorities, which comprises Kerry County Council, Tralee Town Council, Killarney Town Council and Listowel Town Council, is inviting tenders for the provision of building cleaning services from competent and experienced contractors for its Corporate Buildings throughout County Kerry.
The service provider shall provide cleaning services at the facilities detailed in Section 3.0 of the Specification. If during the term of the contract, there is a change in Kerry Local Authorities facilities that necessitates an extension or reduction in the cleaning service required, the service provider shall co-operate in the implementation of all such changes, including in the contraction or extension of the services as appropriate. Any extension of the cleaning services will be provided on the basis of the hourly rates specified in the tender.

Legal, economic, financial and technical information
Conditions for participation
Economic and financial standing:
All Tenderers must demonstrate that they can meet the following financial and economic standing requirements and must be able to furnish the following documentation. Tenderers will either pass or fail this qualification criteria.
Tax clearance certificate.
Service providers should be aware that a current tax clearance certificate or demonstration of a satisfactory level of subcontractor tax compliance will be required from the successful service provider prior to entering into a contract. Successful service providers must comply with the terms of the Department of Finance Circular 43/2006: Tax Clearance Procedures: Public Sector Contracts, or any replacement. These certificates and clearance requirements will be required prior to the contract award. Service providers are now required to produce an in date Notification of Determination to the Contracting Authority or principal contractor, before the contract is awarded. Service providers requiring further information on demonstration of satisfactory level of subcontractor tax compliance and Notifications of Determination under Section 530I should contact their Local Revenue.

Evidence of turnover.
The service provider will be required to provide evidence in relation to turnover for the 3 previous financial years in connection with building cleaning services and overall turnover.
Minimum Requirements: The minimum threshold for annual certified turnover related to building cleaning services must be equal to or greater than the annual figure tendered (excl VAT) and must show positive profit levels.
The service provider will be required to provide an Auditor’s Statement from the Company’s Auditor’s certifying the company’s turnover and profit levels for the 3 previous financial years in connection with building cleaning services and overall Turnover.

Banker’s letter.
The service provider will be required to provide a letter from the service provider’s current principal banker dated within past 3 months, stating that, "to the best of its knowledge, this is the service provider’s principal account and it is currently in good standing and they are financially capable of providing the proposed services".

Public liability insurance.
The service provider will be required to produce evidence from their Insurance Company in the form of the policy confirming that the applicant has current Public Liability insurance cover complying with the requirement(s) set out below.
Minimum level of Public Liability Insurance required in respect of any one accident: 6 500 000 EUR.
The policy will have to be extended to indemnify Kerry Local Authorities, which comprises Kerry County Council, Tralee Town Council, Killarney Town Council and Listowel Town Council.
The service provider will be required to provide a letter from the service provider’s Insurance Company confirming that the required Public Liability insurance can be obtained.
Employer’s liability insurance.
The service provider will be required to produce evidence from their Insurance Company in the form of the policy confirming that the applicant has current Employer Liability insurance cover complying with the requirement(s) set out below.
Minimum level of Employer’s Liability Insurance required in respect of any one accident: 13 000 000 EUR.
The service provider will be required to provide a letter from the service provider’s Insurance Company confirming that the required Employer’s Liability insurance can be obtained.
Tenderers must provide the specified documentation when requested by the Contracting Authority. However, where the Tenderer is unable, for a valid reason, to provide the specified documentation, the tenderer must inform the Contracting Authority of that valid reason as to why the documentation cannot be supplied and provide such other suitable alternative documentation to prove, to the satisfaction of the Contracting Authority, their economic and financial capacity.

Tenderers should note that economic operators relying on the capacity of other entities must, when requested by the Contracting Authority, submit an undertaking, duly evidenced, from those entities that they will place necessary resources at the disposal of the Tenderer.

Technical and professional ability:
All tenderers must demonstrate that they have the following technical and professional ability and must furnish the following documentation with their tenders. Tenderers will either pass or fail this qualification criterion.
In the context of technical capability the tenderer should carefully consider the responses in this subsection in relation to the role that is required for the contract.
Service provider details.
The service provider must complete the Service Provider Details in Appendix 1.3 of this RFT.
Educational and professional qualifications and relevant experience (management).
The service provider must provide evidence of educational and professional qualifications (with dates obtained) and experience (on similar projects) of their managerial staff, and include the curricula vitae of the managerial staff and the organisation structure.

The service provider must identify the personnel to be assigned to manage and supervise the contract.
Projects of similar nature provided over the past 5 years.
The service provider must provide details of between 3 and 5 building cleaning services contracts that the service provider has provided over the past five years that are similar in nature and complexity to this contract.
As a minimum standard, the service provider must have experience in successfully managing and carrying out at least two similar type and sized building cleaning services contract in the past 5 years i.e. The service provider must show that they have managed and carried out building cleaning services for public or private organisation with multiple facilities (in excess of 15) dispersed over a large geographical area.

The Contracting Authority may contact any or all referees without prior notice being given to the service provider.
Average annual manpower over the past 3 years.
The service provider must provide evidence for the 3 previous years of the average annual manpower and managerial staff. The service provider must demonstrate that they have sufficient managerial staff and operatives to perform the services required.

Safety and health.
The service provider must complete the Safety & Health Questionnaire in Appendix 1.2 of this RFT to demonstrate the competence of the service provider to operate in a safe manner and in compliance with all relevant Safety and Health legislation.
The service provider must provide its current Safety Statement (complete document). The Safety Statement must have been reviewed within the past 12 months.
Tenderers should note that economic operators relying on the capacity of other entities must submit with their tender an undertaking, duly evidenced, from those entities that they will place the necessary resources at the disposal of the tenderer.

Payments shall be in accordance with the Conditions of Contract enclosed in Appendix 6 of the attached RFT.

Any consortium or group if awarded the contract must form a legal entity before entering into the contract and each member must be jointly and severally liable.
Other particular conditions:
The documentation required to demonstrate that tenderers can meet the economic and financial standing qualification criteria will be requested by the Contracting Authority prior to (and shall be a condition of) the award of contract.
