Technical services for waste licensing and remediation/reclamation projects in County Cork

Cork County Council

Cork County Council is engaging in a competitive tendering process for technical services in respect of waste licensing and remediation/reclamation projects in County Cork. The requirements are divided into 2 lots:
— Lot 1: Single-operator framework agreement for multi-disciplinary environmental advisory services in relation to a waste licensing and remediation/reclamation project at Haulbowline Island, Co. Cork, and
— Lot 2: Multi-operator framework agreement for multi-disciplinary environmental consultancy and design services.
Interested parties may apply for one or both Lots. The successful economic operator under Lot 1 will be involved in preparing briefs and evaluate proposals submitted by the successful operators under Lot 2. Therefore, in order to avoid any potential conflict of interest, the same economic operator will not be permitted to be admitted to both frameworks. To this end, it is envisaged that a decision on the competition for Lot 1 will made first.

Description of options:

The Council reserves the right to exercise the option referred to in Article 31(4)(b) of the Public Sector Directive / Article 32(5)(f) of the European Communities (Award of Public Authorities Contract) Regulations 2006 (S.I. No. 329 of 2006) to award to the Consultant under each Lot new services consisting in the repetition of similar services to those entrusted to the Consultant, provided such services are in conformity with a basic project for which a Contract was awarded. This option may only be used by the Council during the three years following the conclusion of a Contract under each framework.

If the Candidate is a consortium or grouping of members, the Candidate must specify the commercial and legal relationship amongst its members and any agreements giving effect to same. The Council reserves the right to request copies of any such agreements.

The Council reserves the right, at its absolute discretion, to require the Lead Firm to contract:

— on the basis of joint and several liability with each member of the Candidate executing the contract,

— with a particular single member of the Candidate as the prime contractor, with the other members providing collateral warranties and/or guarantees, or

— as an incorporated or unincorporated special purpose vehicle, with collateral warranties and/or guarantees from the members of the Candidate.
