Cork County Council is subject to the requirements of the Freedom of Information Act, 1997. If an Applicant considers that any of the information supplied with his application is either commercially sensitive or confidential in nature, this should be highlighted and the reasons for its sensitivity specified. Conditions for participation
Suitability to pursue the professional activity:
(1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.

(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.

Deposits and guarantees required:
Professional indemnity and other insurances in accordance with the suitability assessment questionnaire will be a requirement of the contract.
Main financing conditions and payment arrangements and/or reference to the relevant provisions governing them:
Standard conditions of engagement for consultancy services, (technical). Cork County Council operates in accordance with the European Communities (Late Payment in Commercial Transactions) Regulations 2002.
Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
Prior to award of Contract any grouping/consortium of consulting engineers must form a single legal entity with joint and several liability.
Other particular conditions:
For applicants resident in the Republic of Ireland evidence that the applicant is operating a pension/sick pay Scheme and is in possession of a current tax clearance certificate, or a C2 certificate. will be required prior to the award of contract.
In the case of a non-resident applicant and their proposed sub-consultants, a statement from the Revenue Commissioners of the Republic of Ireland in lieu of a current tax clearance certificate as to the suitability of the applicant, on tax grounds, will be required prior to the award of contract. Failure to produce the required documentation within the specified time period may disqualify the applicant.
