As these are Title III Services, this competition is being conducted under Regulation 74 of the European Union (Award of Public Authority Contracts) Regulations 2016 (the “Regulations”) and accordingly is subject only to limited aspects of the Regulations. Consequently, Enterprise Ireland is seeking to establish a Single-party Framework using the Single Stage with Negotiation and as such there is no separate pre-qualification stage in this competition and any interested party may submit a tender in response to the Invitation to Tender (ITT) issued. Those tenders will be evaluated to ensure they meet the specification, selection and award criteria. If the negotiation stage is utilised, negotiation meetings will be held which could result in a subsequent request for Best and Final Offers. Please note that under this procedure the buyer reserves the right to award the contract on the basis of the initial tender without any further negotiations. If Enterprise Ireland elects to enter into negotiations it may apply the successive reduction rule, meaning not all initial Tenderers will be invited to negotiate, and consequently invited to submit Best and Final Offers. Please refer to Section 3 of the ITT for additional information on this procedure.
