The Health Service Executive (HSE) is a publicly owned, national, statutory body created by the Health Act, 2004 to manage and deliver or arrange to be delivered on its behalf, health and personal social services throughout Ireland. As part of the Scoliosis and Spina Bifida Action Plan, the HSE is actively seeking to reduce the waiting time children and adolescents resident in Ireland should wait for paediatric orthopaedic surgery for conditions such as Spina Bifida and Scoliosis. As part of this plan, the HSE wishes to engage with a number of hospitals to deliver the procedures listed at Appendix 2 of the Invitation To Tender. It shall be a requirement that all medical devices and implants used as part of any surgery performed pursuant to the Panel Agreement are CE marked. Treatment for the relevant procedures will be funded through the HSE. The treatment of paediatric scoliosis involves complex spinal surgery. The HSE is only willing to entrust the treatment of HSE patients to hospitals of the highest quality in terms of the clinical team and the hospitals facilities and resources. The ability of the hospital and its clinical team to provide the highest level of care to the patient and their accompanying parent/guardian or carer is of paramount importance. This process is being conducted under Title III - Particular Procurement Regimes, Chapter I - social and other specific services of Directive 2014/24/EU. The required services are listed as Annex XIV services and, accordingly, only Articles 74-77 of Directive 2014/24/EU apply. The HSE may negotiate on all aspects of tenders and may engage in direct dialogue on all matters associated with this process. Such negotiations will be conducted with due regard to the principles of transparency and equal treatment. The intention is that, subject to market response, four (4) hospitals will be appointed onto the Panel for provision of the procedures listed in the procurement document.
