(b) If insurance is being provided on a cross border basis the insurance company must comply with the appropriate provisions of the second non life insurance services directive implemented in Ireland by S.I. Agreement will be reached by the successful tenderer and the contracting authority as to the claim handling protocol that will operate in an accident scenario. The tenderer must provide their agreement in writing to this requirement prior to any contract being signed by the contracting authority
