As this contract was procured and awarded under the European Union (Award of Concession Contracts) Regulations 2017) article 41 (c) of those regulations applies. The NTMA is satisfied that the modifications to the contract fulfils all the conditions described in article 43(1)(c) and 43(1)(e) as: (i) the NTMA could not have foreseen the implementation of the Covid-19 restrictions in March 2020 and for those restrictions to remain in place until the end of January 2022, with the impact of such restrictions being that the concessionaire could not perform the required services as per the contract during that time; (ii) the modification to extend the contract term to provide catering services does not alter the overall nature of the concession contract as the services remain the same; (iii) the increase in value of the contract including costs arising from this modification does not exceed 50 % of the value of the original concession contract; and (iv) the proposed modification is not considered to be substantial as it does not render the contract materially different in character from the one initially awarded.

The modification that is the subject of this notice is an extension to the contract term because of the impact of the Covid-19 restrictions from 2020-2022 on the concessionaire’s ability to perform the services. The services required the concessionaire to mobilise the catering services for the NTMA in Treasury Dock and provide those Services for a continuous period of 5 years. The impact of the Covid-19 restrictions was such the concessionaire could not provide the Services as envisaged in the contract for a period of c. 2 years from early March 2020 to the end of January 2022. In addition, the concessionaire was required to recruit and mobilise a catering team in both 2019 at the start of the services and again in 2022 as the Covid-19 restrictions were gradually removed, which was not foreseen in the contract.
