In relation to the City Wide Area Lot (Lot 6), a Random Selection of 8 contractors on the City Wide Area Lot (Lot 6) Framework shall take place, the first 3 contractors of the Random Selection shall be requested to provide a detailed quotation for the proposed works. Applicant should declare by letter the Lot or Lots they wish to apply for. A single application is only required since the same criteria apply to all the Lots. Applications are invited from contractors who have experience of residential refurbishment and maintenance work. The Official Government Pre-qualification Questionnaires and marking system is applicable to all Contractors (see pre Qualification Questionnaire available at: www.etenders.gov.ie) and attached documentation. This competition allows the use of self-declaration certificates to confirm compliance with minimum standards for the relevant criteria in the suitability questionnaire. This will avoid the submission of detailed evidence at tender stage. Transfer of undertakings (protection of employment) regulations: The attention of Tenderers is drawn to the Transfer of Undertakings (Protection of Employment) Regulations 1981 as amended (TUPE). In some cases, where work awarded to a contractor is subsequently awarded to another organisation, such a transfer of work may constitute a โ€˜transfer of an undertakingโ€™ for the purposes of TUPE. TUPE provides that where there is a transfer of an undertaking (or possibly part of 1), the new employer takes over any employment liabilities and the responsibility for the employment contracts of the employees, who then transfer on their previous terms and conditions of service. As a successful tenderer may be a potential transferee for the purposes of TUPE, tenderers should seek legal advice as to whether TUPE will be likely to apply to the proposed contract, and if so, to reflect the financial implications of such a transfer in their tender. In such cases, as the Department will be neither transferee nor transferor for the purposes of TUPE, the application of TUPE is a matter for each tenderer to clarify with their legal advisers. If TUPE is deemed to apply then the financial implications are a matter for discussion between the prospective tenderer and the existing contractor, rather than for the Department. Tenderers whose price for the lot under consideration is not ranked lower than position 8 of the ranking order when the bids are assessed will form the framework of contractors for that lot. When refurbishment and/or maintenance work in each of the 5 areas excluding the City Wide Area lot is required then task order/s will be issued to the contractor ranked number one in the lot.Task orders will be valued on the basis of the pricing document submitted by contractor number one under the terms of the contract. Further task orders may be issued to the contractor ranked number one until such time as it is deemed by the area maintenance officer that this contractor has reached its capacity for the purposes of satisfying the area maintenance programme. In relation to the City Wide Area lot (lot 6), a random selection of 8 contractors on the City Wide Area lot (lot 6) framework shall take place, the first 3 contractors of the random selection shall be requested to provide a detailed quotation for the proposed works. A tenderer may apply for inclusion in any or all of the 6 lots. No contractor will be permitted to be in possession of 50 or more units requiring repair/refurbishment at any given time.
