3) If for any reason it is not possible to agree the contract terms and conditions with the successful tenderer following the competitive process or the appointed contractor fails to deliver the services in accordance with the terms and conditions, ITT reserves the right to appoint the next highest scoring tenderer as its contractor at any time during the 12 month tender validity period. This shall be without prejudice to the right of ITT to cancel this competitive process and or initiate a new contract award procedure at its sole discretion.
4. This notice is strictly voluntary and the awarding authority is not subject to the provisions of Directive 2004/18 relating to the choice of publicity, procedures, timelines, selection or award criteria.
