The combined cycle gas turbine power station, to be constructed east of Knottingley, West Yorkshire, UK, will consist of up to 3 separate single shaft generating units, hybrid cooling towers and other ancillary structures and will have a nominal net electrical output capacity of no more than 1 500 MWe at ISO conditions. The power station will be gas fired and served by an 8 km long underground gas pipeline connecting the power station to the National Grid Transmission System south of the town of Gateforth. Electrical connection works, to be undertaken by others, will take place directly adjacent to the power station to facilitate connection to the National Grid 400 kV electricity transmission system. Cooling water will be available from either the adjacent Aire and Calder Navigation canal or the River Aire located approximately 1 km away.
This call for competition notice is published on a voluntary basis by the purchaser. this procurement competition is not governed by the Utilities Directive given the exemption under Article 30 of Directive 2004/17 EC (Utilities Directive) for the Great Britain electricity generation sector and it is not intended that the Utilities Directive procedures will be applied to this procurement competition.

It is ESB's intention to shortlist suitable candidates. ESB will not be responsible for costs, charges or expenses incurred by candidates, whether or not a final contract is awarded. This notice is to serve as the sole call for competition for this contract. Requests cannot be entertained beyond the date stipulated in Section IV.3.3.e). In connection with the award of the contract, the tenderer shall be required to identify the entity that would be responsible for the receipt and processing of orders and the resolution of any and all problems relating to this contract. In responding to this notice, companies must indicate if they propose to submit a group bid and, if so, must provide full details of the participating companies (see section III.1.3). The negotiated procedure will be used, however, the contracting entity retains the option to accept initial bids without further negotiations. Award to runner up — if for any reason it is not possible to conclude the contract with the designated successful tenderer emerging from this competitive process, The Purchaser reserves the right to award the contract to the next highest scoring tenderer on the basis of the terms advertised. This shall be without prejudice to the right of the Purchaser to cancel this competitive process and/or initiate a new contract award procedure at its sole discretion. The Purchaser reserves the right to seek additional contractual and commercial safeguards in the event that the financial position of the proposed vendor deteriorates. The Purchaser also reserves the right not to award the contract to the proposed vendor in such circumstances. The contracting entity reserves the right to conclude this contract, or withdraw from the process, at its sole discretion.

Applicants are required as part of their expression of interest to provide confirmation of the following:

— a statement that no record exists against the bidder of successful court actions involving fraud or other major breaches of the Companies Acts in England and Wales or similar law in any other jurisdiction;

— a statement that the applicant has fulfilled its obligations relating to the payment of taxes and social security contributions in England and Wales or any other state in which the applicant is located;

— a statement that the applicant has within the last year complied with all appropriate labour legislation relevant to pay and pension;

— a statement that the applicant will during the course of the contract term for this project comply with all applicable and appropriate labour legislation relevant to pay and pension.

Economic and financial standing:

Candidates must demonstrate that they have adequate financial capacity to deliver the project.

Applicants are required, as part of their expression of interest, to provide the following:

— Audited financial statements for the applicant's proposed contracting entity for the most recent 3 financial years. Such financial statements must include at a minimum:

(i) profit and loss account/income statement,

(ii) balance sheet,

(iii) cash flow statement if applicable and

(iv) the detailed explanatory notes associated with balances within the financial statements. If audited financial statements are not available for the most recent financial year, up to date management accounts including appropriate explanatory notes should be submitted;

— Evidence of current levels of insurance cover. Such evidence may be in the form of either:

(a) copies of the relevant insurance certificates for each of the insured risks; or

(b) letter from insurance broker providing details of insurance cover in respect of the following risks:

(i) employer's liability,

(ii) public liability,

(iii) professional indemnity,

(iv) motor insurance,

(v) travel Insurance (if applicable);

— Confirmation that the applicant will be in a position to raise the bonds associated with the contract from a bank which maintains a long term credit rating of not less than A (Standard and Poors) or A2 (Moody's Investors Services, Inc.);

— Applicants are requested to indicate whether Export Credit Agency support is available and if so advise of the appropriate Agency name if available please provide details on the most recent projects completed with export credit agency support;

— Applicants are requested to indicate whether debt financing is available or if a debt financing department exists within the organisation.

Technical and professional ability:

The Applicant is requested to advise if it is sufficiently equipped with the infrastructure, i.e. design capabilities and facilities, tools, plant, technical equipment and personnel, to fulfil all contractual obligations to undertake a turnkey EPC contract for a gas turbine combined cycle power plant of up to 1 500 MW and associated equipment and services, utilising modern and state of the art technologies?

Has your company supplied, installed, and commissioned at least 3 combined cycle power plants on a full scope turn key EPC based utilising latest Gas Turbine technology, rated greater that 250 MW each? Please provide details.

Details of the applicants capability to provide power train (gas turbine, steam turbine, generator) maintenance, services and components as part of a Long Term Services Agreement (LTSA). Please indicate the existing number of LTSA agreements you have in place and the technology to which it applies.

Are you a gas turbine designer and manufacturer willing to accept sole contract liability or does your consortium include a gas turbine designer and manufacturer which accepts joint and several liability?

Are you willing to conduct all business in the English language, have site supervisors and project managers that are proficient to communicate in English, and to provide installation, operation, maintenance and training manuals in English?

Operates an ISO 9001/EN29001 (or equivalent) quality assurance system and ISO 14000 (or equivalent) quality and environmental assurance systems. If yes please indicate if your systems have been assessed by an accredited independent organisation. Please provide copies of current certificates clearly indicating the scope of the certification. If you are in the process of obtaining certification please state the quality standards sought and the expected date for certification.

Provide details of similar contracts (in nature and scale) successfully completed on a turnkey Engineer Procure and Construct basis within the past 5 years including details of customer name, location and whether the plant successfully met the required levels of performance for plant output, efficiency and availability guaranteed. The applicant should clearly indicate whether it was the contracting entity for the project.

Confirm willingness to offer guarantees for programme, output and efficiency, warranty period and environmental factors (where appropriate) and accept that liquidated damages will be applicable for failing to meet the guarantees.

Provide the number of 3 day injury incidents to your employees and contractor/subcontractors workers involved in the construction projects detailed in the last 4 years. For the purposes of this question: 3 day injury incident = injury that resulted in a worker being away from work or incapacitated for more than three consecutive days (not counting the day of the accident but including any weekends or other rest days) and excluding fatalities.

Provide the number of Lost Time Incidents (LTI's) to your employees and contractor's/sub-contractor's workers involved in the construction projects detailed in the last 4 years. For the purposes of this question: LTI = injury incident resulting in a worker being away from work or incapacitated for the next working day or next normal working shift and excluding fatalities and 3 day injury incidents.

Provide the statutory reportable dangerous occurrence frequency rate for your contracting entity. The definition of reportable dangerous occurrence is as prescribed in local legislation.
