Multi-Party Framework Agreement for Legal Services
Health and Social Care Professionals Council (CORU)
CORU (Health and Social Care Professionals Council) wishes to establish a multi-party framework agreement, in a single lot, for legal services including Regulatory Advisory Services and General Advisory Services. The max framework duration
will be for 6 years comprising an initial 4 years, followed by a possible option for one extension of two years. This will include advice and representation, in a number of areas related to its operations. The estimated annual expenditure on legal services is in the range of 50,000 EUR - 70,000 EUR per annum.
(i) Regulatory Advisory Services
Comprises the provision of legal advice and services relating to:
— Registration, Recognition and Education functions under the Health and Social Care Professional Act 2005 (as amended) (the Act).
— Registration Appeals
— Recognition Appeals
— Judicial Reviews
— Drafting of Statutory Instruments
(ii) General Advisory Services
Comprises the provision of legal advice and services relating to Corporate and other matters including:
— Enforcement including prosecutions (under Sections 59 and 80 of the 2005 Act)
— Property
— Freedom of Information
— Corporate Governance
— Employment
— Procurement
— Litigation/Dispute Resolution
— Contracts
— Intellectual Property
— Data Protection
- Ethics in Office
It is anticipated that the expenditure will be divided into 80 % for Regulatory Advisory Services and 20 % for General Advisory Services.
The above requirements represent the current anticipated range of legal services required by CORU during the operation of the proposed framework. However, due to on-going review and development of services provided by CORU, it is expected that additional legal service requirements may arise during that period.
Taken overall, the contracting authority's historical annual expenditure on legal services has been in the region of 50,000 EUR per annum. This information is provided for information purposes. Coru has undertaken a phased approach to implementation of its operations and will likely become fully operational during the term of the framework. As a consequence, expenditure on legal services will increase significantly over current levels. Expenditure over the maximum potential 6 year duration of the framework is therefore estimated to be in the range 300,000 EUR - 420,000 EUR. However, no guarantee can be given of the volume of work to be awarded during the life of the framework agreement.
