JM/001/014 — Multi-operator framework agreement for the supply of incontinence products

Saint John of God Hospitaller Ministries (Ireland) (the ‘Contracting Authority’) provides services in the areas of intellectual disability, mental health and older people. Our services are grouped into a number of limited companies whose Chief Executives report to Group Chief Executive (the ‘SJOG Services’). Each of the SJOG Services are in turn subdivided into a number of discrete operational units (the ‘SJOG Units’) led by a Unit Manager/Nursing Manager.
The Contracting Authority is now seeking to establish a multi-operator framework agreement for incontinence products covering the entire Saint John of God Hospitaller Ministries (Ireland) for use by all the SJOG Units.
Under this framework agreement, which will be established with three operators, all orders will be placed with a single operator during the initial two (2) years, following which a mini-tender competition will be held amongst the three framework members to determine the successful operator for the following two (2) years.

— on the basis of joint and several liability with each member of the tenderer executing the contract,
— with a particular single member of the tenderer as the prime contractor, with the other members providing collateral warranties and/or guarantees; or
