1. Dublin City Council is subject to the provisions of the Freedom of Information Act (FOI) 1997, 2003. It will be a condition for the award of any contract by Dublin City Council that the successful Tenderer and all sub-contractors produce a valid Tax Clearance Certificate from the Revenue Commissioners. In the case of a non-resident Tenderer, a statement of suitability from the Revenue Commissioners will be required. Any contract award is also subject to satisfactory confirmation from the Candidates insurers that the candidate can comply with the insurance requirements of the contract.
3. Suppliers must register their interest on the eTenders web site (www.etenders.gov.ie) in order to be included on the mailing list for clarifications.
4. Please note in relation to all documents, that where reference is made to a particular standard, make, source, process, trademark, type or patent, that this is not to be regarded as a de facto requirement. In all such cases it should be understood that such indications are to be treated strictly and solely for reference purposes only, to which the words "or equivalent" will always be appended.
5. The Contracting Authority will not be responsible for costs, charges or expenses incurred by candidates, whether or not any contract is awarded under the framework agreement. The Contracting Authority reserves the right to conduct interviews with the candidates short listed as a result of this competition. The Contracting Authority reserves the right to make award of contracts for Planning, Urban Design, Strategic and Regional, Retail, Transport etc. services outside of the framework agreement where appropriate. Separate contracts will be awarded for each project requirement as it arises and a service provider may be appointed to provide more than one service.
6. The service provider appointed will be required to indemnify and keep indemnified Dublin City Council against all claims, demands, proceedings, costs and expenses made against the City Council arising from or out of the performance by the Service Provider of their duties under the request for tender and shall maintain such indemnity in respect of their services for the period of the agreement.
7. Please note also that all information relating to attachments, including clarifications and changes, will be published on the Irish Government Procurement Opportunities Portal (www.etenders.gov.ie) only. Registration is free of charge. Dublin City Council will not accept responsibility for information relayed (or not relayed) via third parties.
8. The Framework Agreement is primarily for use by the Planning and Economic Development Department, but may also be extended for use by other divisions of Dublin City Council as requirements arise.
