Courts Bundle Public Private Partnership (PPP)

Following on from the Prior Information Notice ("PIN") (RFT 80008), the National Development Finance Agency, acting for and on behalf of the Department of Justice and Equality (โ€œDJEโ€) (as Sanctioning Authority ) and the Courts Service (as Sponsoring Agency) intends to procure the Courts Bundle PPP (the Project) to design, build and/or extend and/or refurbish (as outlined in the Project Information Memorandum/Pre-Qualification Questionnaire document attached to the eTender's notice), finance and maintain seven courthouses located in the counties of Louth, Donegal, Limerick, Wexford, Cork, Westmeath and Waterford. It is expected that the Project will have an ex VAT capital value in the order of 120 000 000 EUR in mid-2016 prices and will be procured under a single PPP contract using the negotiated procedure. The NDFA intends to include provisions within the contract and tender documents relating to the provision of social and/or community benefits, including in particular training and/or employment opportunities for unemployed construction operatives and related personnel, architects, engineers or technicians (as appropriate), facilities management operatives and related personnel, etc.

It is anticipated that the Project will be a Public Private Partnership of 25 years' duration from service commencement date. It is expected that the Project will be funded by private funding and payment will be by monthly unitary payment subject to the terms and conditions of the contract. The NDFA intends to use its Template Project Agreement as the form of contract for the Project, with some amendments to reflect prevailing market conditions.

There is no intention that the Government participate as an equity provider to the Project. Information on the potential approach to funding is set out in the Project Information Memorandum/Pre-Qualification Questionnaire published with this contract notice. There is no intention to hold any form of equity funding competition during the course of the procurement and contract award processes (i.e. inviting the participation of parties not previously members of the candidate as constituted at prequalification stage).

The Irish Government decided in December 2012, on a temporary and exceptional basis, to authorise some reimbursement of tender costs for accommodation projects in the new PPP Programme. The Government agreed that the invitation to negotiate may include provision for a payment to be made to 2 unsuccessful tenderers submitting a compliant tender. In addition, in the event that a Project does not proceed to the award stage, payment may be made to the three shortlisted tenderers.
