Quantity or scope

ESB invites expressions of interest from suitably qualified candidates interested in being considered for the following scope of work:Thorough examination by a competent person of the following items of equipment:1. Boilers, steam receivers and steam containers (e.g. blowdown tanks, deaerators, drain tanks, heaters).2. Compressed air receivers (e.g. instrument air receivers, firefighting air/water pressure tanks, accumulators).3. All other pressure vessels not excepted from Part 10 of SI No. 445 of 2012 as listed in Schedule 12 thereinat the required statutory intervals, in accordance with Irish Legislation currently in force including the Safety, Health and Welfare at Work Regulations 2012 (S.I. No 445 of 2012) and Safety, Health and Welfare at Work Act 2005 (commencement) Order 2012 (S.I. No. 446 of 2012) in ESB Power Generating plants in Ireland.ESB will use the negotiated procedure. Parties interested in being considered for this project must respond to the information requested and criteria and rules outlined in Sections III.2.1), III.2.2) and III.2.3) of this Call for Competition.

Additional information

a) all queries should be submitted at least seven days before the closing date to enable responses to be issued to all interested candidates prior to the deadline date for the receipt of applications.

b) A soft copy of an Applicants Expression of Interest must be submitted by closing date (See section VI.5) to the email address in I.1) above. The Expression of Interest must include all of the selection criteria and information requirements identified in Sections III.2.1), III.2.2) and III.2.3) above.

c) It is ESBs intention to shortlist suitable candidates.

d) ESB will not be responsible for costs, charges or expenses incurred by candidates, whether or not a final contract is awarded.

e) This notice is to serve as the sole Call for Competition for this contract.

f) Requests cannot be entertained beyond the date stipulated in Section IV.3.3) e) In connection with the award of the contract, the Tenderer shall be required to identify the entity that would be responsible for the receipt and processing of orders and the resolution of any and all problems relating to this contract.

g) In responding to this notice, companies must indicate if they propose to submit a group bid and , if so, must provide full details of the participating companies. (See section III1.3)

h) The negotiated procedure will be used, however, the contracting entity retains the option to accept initial bids without further negotiations.

i) ESB reserves the right to award the contract in full or in part, or not at all.

j) Suppliers attention is directed to Article 58.2 of Directive 2004/17/EC

k) Award to Runner Up - If for any reason it is not possible to conclude the contract with the designated successful tenderer emerging from this competitive process, ESB reserves the right to award the contract to the next highest scoring tenderer on the basis of the terms advertised. This shall be without prejudice to the right of ESB to cancel this competitive process and/or initiate a new contract award procedure at its sole discretion.

l) ESB reserves the right to seek additional contractual and commercial safeguards in the event that the financial position of the proposed vendor deteriorates. ESB also reserves the right not to award the contract to the proposed vendor in such circumstances.

m) the contracting entity reserves the right to conclude this contract, or withdraw from the process, at its sole discretion.

n) the contract may initially be for a duration of three years subject to annual review with the purchasers option to extend for a further two years subject to satisfactory performance and suitable commercial terms.

Legal form to be taken by the group of economic operators to whom the contract is to be awarded

If the Tender is submitted by a group of suppliers, then those suppliers, if awarded the contract, shall assume such legal form by corporation, partnership or otherwise as will enable them to contract as a single entity, and assume joint and several responsibility for the contract. The requirements in Section III 2.1) must be met in full by each group of bidders.
