The Framework Agreement will be established for a term of eighteen (18) months with an option to extend annually for a period of up to two years. to a maximum cumulative term of three years and six months, at the sole discretion of Irish Water.

A consortium/joint venture will not be required to convert into a specific legal form in order to submit a Pre-Qualification Submission, but may be required to do so prior to award of the Framework Agreement. Irish Water may:
i. contract with the prime contractor only;
ii. contract with each member of the consortium/joint venture on the basis of joint and several liabilities;
iii. contract with one member of the consortium/joint venture as prime contractor to whom the other members will be sub-contractors; or
iv. at its discretion, require the consortium/joint venture to enter into any other contracting arrangement.
