This shall be without prejudice to the right of the contracting authority to cancel this competitive process and/or initiate a new contract award procedure at its sole discretion;
7) At its absolute discretion, the contracting authority may elect to terminate this procurement process, the framework agreement or any contract awarded under the framework agreement at any time.

Short description:
The Grangegorman Development Authority (GDA) is a statutory agency established in 2006 to redevelop the Grangegorman site in Dublin city centre. The challenge is to plan for and implement a complex, multi-phased development that provides:
โ A high quality area with physical linkages to Smithfield, Phibsborough, Prussia Street, and the City Centre,
โ New health care facilities for the health service executive (HSE),
โ New urban campus for Dublin Institute of Technology (DIT),
โ New arts, cultural, recreational and public spaces to serve the community and the city,
โ Primary school, public library and childrenโs play spaces, and,
โ Complementary mixed-use development.
The GDA proposes to engage in a competitive process for the establishment of a single party framework agreement for multi-disciplinary design services for protected structures. The multi-disciplinary design team will contain the following disciplines:

โ On the basis of joint and several liability with each member of the Candidate executing the contract,
โ With a particular single member of the Candidate as the prime contractor, with the other members providing collateral warranties and/or guarantees; or,
โ As an incorporated or unincorporated special purpose vehicle, with collateral warranties and/or guarantees from the members of the Candidate.

The Grangegorman Development Agency wishes to deliver โcommunity benefitโ outcomes from its procurement activity with a view to ensuring that wider social issues are taken into account when spending public money. The intention is to achieve the very best value for money in the widest sense.

The GDA has accordingly adopted the Grangegorman Employment Charter (Charter) which contains contract performance conditions related to social considerations. The works contractor will be required to implement the Charter as a condition of its contract. The obligations under the Charter apply only in respect of the performance of the Works and the works contract. The Charter forms part of the Works Requirements for the worksโ contractor.
The GDA has accordingly adopted the Grangegorman Employment Charter (Charter) which contains contract performance conditions related to social considerations. The works contractor will be required to implement the Charter as a condition of its contract. The obligations under the Charter apply only in respect of the performance of the Works and the works contract. The Charter forms part of the Works Requirements for the worksโ contractor.
The Charter requires the design team to monitor the worksโ contractorโs implementation of the Charter and to report on this to the GDA. This is so that the GDA can ensure that the worksโ contractor properly implements the Charter.
The Design Team will be required to comply with these obligations as a part of its obligations under its Contract with the GDA.
