(1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent;

(2) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register;
(3) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process;
(4) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law or of the relevant State in which the economic operator is established.
(1) All candidates will be required to provide evidence of relevant professional risk indemnity insurance;
(2) All candidates will be required to provide statements of accounts or extracts from those accounts relating to their business.
1. All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register;
2. The manufacturer must meet the hygiene standards as set out in Article 4 of Regulation (EC) No 852/2004 and 853/2004 (butter only). Evidence must be supplied such as HACCP documentation;
3. The products must be manufactured in a production premises approved under Article 6 of Regulation (EC) No 852/2004 or SI 432/2009 and in a production premises approved under the national law of the Member State in which the establishment is located. Approval number or evidence of registration or approval must be submitted.

Deposits and guarantees required:
Before a contract is awarded to the successful tenderer, the tenderer must lodge a security equal to 110 % of the amount of the tender. The security must be in the form of a bank draft, electronic funds transfer or guarantee by a credit institution approved for that purpose by the dept of agriculture, food and the marine. The security must reach or be lodged with the dept of agriculture, food and the marine, Johnstown Castle Estate, Wexford prior to award of contract. The guarantee must be on headed paper of the credit institution (Approved list of credit institutions is available from the Department) Any expense in providing the security will be a matter for the tenderer.

Other particular conditions:
1. Products supplied to include manufacturing, packaging, labelling, all-risks insurance during transport to the storage depot(s);
2. The products must be manufactured in a production premises approved under Article 6 of Regulation (EC) No 852/2004 and in a production premises approved under the national law of the Member State in which the establishment in located;
3. The manufacturer must meet the hygiene standards as set out in Article 4 of Regulation (EC) No 852/2004 and 853/2004;
4. The products shall be packed in new, strong material in such a way as to ensure it is protected throughout transportation, storage and removal from storage;
5. The products must comply with the standards, including materials, characteristics, manufacturing method, sampling and analysis as set out in the Codex Alimentarius;
6. The inner and outer packaging shall show at least the following particulars;
a) The approval number identifying the manufacturing premises and member state of production;
b) The date of production;
c) The best before date;
d) The words "European Union Aid - not for resale"
7. The inner packaging must also show the words "European Union Aid" accompanied by the European Union emblem following the instructions given in Annex II of Commission Regulation (EU) No 807/2010 and shall be clearly visible on the packaging of the individual packages.
