Quantity or scope

This contract provides for the construction and maintenance for a period of 12 months of the following works:— 5km of 800mm diameter ductile iron pipelines,— Railway, canal and motorway trenchless technology crossing works,— Pipe fittings, instrumentation and chambers,— Telemetry outstations.

— The suitability assessment submissions should be delivered by registered post, recorded delivery service or by hand so as to arrive not later than the date and time given in the contract notice. Applicants for suitability must return two (2) copies of the completed suitability assessment questionnaire and appendices, in a sealed envelope, clearly marked with:

— Applicants are advised that Kildare County Council is subject to the requirement of the Freedom of Information Act, 1997. If an applicant considers that any of the information supplied with his submission is either commercially sensitive or confidential in nature, this should be highlighted and the reasons for its sensitivity specified. In such a case, the relevant material will, in response to a request under the Act, be examined in light of the exemptions provided in the Act,

— Prior to appointment the successful tenderer will be required to produce a current tax clearance certificate or C2 certificate from the Republic of Ireland Revenue Commissioners. In the case of a non-resident tenderer, he should be in a position to produce a statement (in lieu of a tax clearance certificate) from the Republic of Ireland Revenue Commissioners that he has satisfied them as to his suitability on tax grounds to be awarded the contract,

— The successful tenderer will be required to provide evidence that he meets the requirements of a registered employment agreement and provide evidence that he operates a satisfactory pension and sick pay scheme,

— Before appointment, the successful mechanical & electrical specialist and trenchless technology specialist will be required to produce evidence from their broker or insurance company confirming that the specialist has current professional indemnity insurance for the amount of 6 500 000 EUR or greater, and that it complies with the conditions set out in the suitability assessment questionnaire forms and that it will be maintained for 6 years after completion of the construction works. Each proposed specialist shall provide evidence from their broker or insurance company confirming that professional indemnity insurance is obtainable and in place before commencement of the works,

— Before appointment, the successful tenderer will be required to produce evidence from their insurance company in the form of policy confirming that the tenderer has current public liability and employers liability insurance cover complying with the requirement(s) set out below. The tenderer shall provide evidence from their broker or insurance company confirming that public liability and employers liability insurances are obtainable and in place before commencement of the works:

—— minimum level of public liability insurance: 12 500 000 EUR,

—— minimum level of public/products/pollution liability insurance required in respect of any one accident for railway crossing works: 50 000 000 EUR.

— Contractor's all risks (CAR) required for railway crossing works: 15 % of contract value,

— Motor (third party property damage) 1 300 000 EUR,

— Minimum level of employer's liability insurance: 13 000 000 EUR,

— Before appointment, the successful mechanical & electrical specialist will be required to produce evidence from their insurance company in the form of the policy confirming that the specialist has current public liability and employers liability insurance cover complying with the requirement(s) set out below. Each proposed specialist shall provide evidence from their broker or insurance company confirming that public liability and employers liability insurances are obtainable and in place before commencement of the works:

—— minimum level of public liability insurance: 12 500 000 EUR,

—— minimum level of employer's liability insurance: 13 000 000 EUR.

— Before appointment, the successful trenchless technology specialist will be required to produce evidence from their insurance company in the form of the policy confirming that the specialist has current public liability and employers liability insurance cover complying with the requirement(s) set out below. Each proposed specialist shall provide evidence from their broker or insurance company or insurance company confirming that public liability and employers liability insurances are obtainable and in place before commencement of the works:

—— minimum level of public liability insurance: 12 500 000 EUR,

—— minimum level of public/products/pollution liability insurance required in respect of any one accident for railway crossing works: 50 000 000 EUR.

Short description

This contract will provide for the construction of an 800mm diameter, approximately 5km long ductile iron pipe from Ballygoran Reservoir to Collinstown, Leixlip, Co. Kildare.

Suitability to pursue the professional activity

Requirements regarding the personal situation of applicants, including requirements relating to enrolement on professional trade registers, are set out in the suitability assessment questionnaire forms.

Economic and financial standing

2. - The applicant will be required to provide a statement, covering the 3 previous financial years including the overall turnover of the applicant and the turnover in respect of the activities which are of a similar type to the subject matter of this notice;

Technical and professional ability

The applicant and each proposed specialist for the mechanical & electrical works and trenchless technology works must provide evidence of educational and professional qualifications (with dates obtained) and experience (on similar projects) of their managerial staff and include the curricula vitae of the managerial staff and the organisation stucture.

Technical and professional ability

—— The applicant and each proposed specialist for the mechanical & electrical works and trenchless technology works shall also provide evidence of education and professional qualifications (with dates obtained) of their personnel proposed, including curricula vitae of personnel. The applicant and each specialist shall also submit an organigram showing the proposed Project Team Structure. The minimum standard shall be as follows:

Legal form to be taken by the group of economic operators to whom the contract is to be awarded

Where a consortium or partnership of firms is proposed, the contracting parties shall form a single legal entity or a consortium with joint and several liability, bound for delivery of works specified in contract documents to be issued by Kildare County Council to longlisted candidates.
