National Sports Campus Development Authority
This document is a Request for Tenders (“RFT”) for the appointment of a Technical Advisor to NSCDA in relation to certain works, which it is proposed will be undertaken at the National Sports Campus, Abbotstown, Dublin 15 by certain third parties, namely the Football Association of Ireland, The Irish Rugby Football Union, the Irish Hockey Association and the Gaelic Athletic Association.

The Consultant will be required to carry out all duties and responsibilities of Technical Advisor to NSCDA in relation to the Relevant Construction Works as set out in more detail in Section 3 of the RFT.
The Consultant will be required, in particular, to monitor and report on the timely and satisfactory completion of the Relevant Construction Works.
A minimum qualification requirement for this tender competition is that the Consultant be able to make available a team including but not limited to at least one person within each Core Staff Category listed in Appendix 9 of the RFT for the purposes of providing the Consultant’s Services.
The Consultant will use the standard of care which would ordinarily and properly be used by an independent consultant in relation to services comparable in size, scope, complexity and purpose to the Consultant’s Services.
The Consultant will agree to act in a thoroughly competent and efficient manner and in the best interests of the NSCDA so as to give to the NSCDA the full and complete benefit of the Consultant’s experience and expertise.
The Consultant will carry out any other supervisory functions or duties in respect of the Relevant Construction Works as the NSCDA may specify from time to time.
For Clarity, the NSCDA is not in a position to forecast the amount and specific types of Consultant’s Services (eg total hours per professional) that will be required during the term of the Agreement (as described in 1.6 below), or to guarantee that a certain minimum amount of Consultant’s Services will be required in any period. This is because the Sports Bodies will be undertaking the Relevant Construction Works independently in accordance with self-imposed timescales and methods. Specifically, the Sporting Bodies are under no obligation to carry out the Relevant Construction Works and thus the Consultant’s Services will not be required in circumstances where the Relevant Constructions Works do not commence within the term of the Agreement.

(1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.

(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.

(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.

TENDERER DECLARATION WITH RESPECT TO EXCLUSION CRITERIA.
1. The Tenderer is bankrupt, or is the subject of proceedings for a declaration of bankruptcy, or is being wound up, or is in administration, or is the subject of proceedings for compulsory winding up or administration, or its affairs are being administered by the courts, or has entered into an arrangement with its creditors, or has suspended its business activities.

2. The Tenderer or a Director or Partner of the Tenderer has been convicted of an offence concerning his professional conduct or has been found guilty of grave professional misconduct in the course of his business.
3. The Tenderer has not fulfilled its obligations relating to the payment of taxes or social security contributions in Ireland or any other State.
4. The Tenderer, or a Director or Partner of the Tenderer has been found guilty of fraud, money laundering, corruption or membership of a criminal organisation. 5. The Tenderer has been guilty of serious misrepresentation in providing information to a public buying agency.

(1) All candidates will be required to provide a reference from their bank.
(2) All candidates will be required to provide evidence of relevant professional risk indemnity insurance.
(3) All candidates will be required to provide a statement, covering the 3 previous financial years including the overall turnover of the candidate and the turnover in respect of the activities which are of a similar type to the subject matter of this notice.

NSCDA is open to receiving joint tenders from groups of individuals / organisations (consortiums), irrespective of their legal form.
In the event of a group of Tenderers jointly submitting a successful tender, it is intended that the contract will be awarded by NSCDA to one legal entity who will agree to act as prime contractor. The prime contractor will be responsible for the delivery of the Consultant’s Services provided for under the terms of the Agreement and shall assume all the duties, responsibilities and costs associated with the position of prime contractor.
