Waterford County Council invites expressions of interest from suitably qualified engineering consultancy companies with experience in water conservation and mains rehabilitation works for the appointment as consultant for the 'Water Conservation Stage 3 Mains Rehabilitation Works'. The appointment shall be in accordance with the "Standard Conditions of Engagement of Consultancy Services (Technical)" published by the Department of Finance. The appointment shall be for the following stages of the project:
Stage (ii) - detailed design/contract documentation.
Stage (iii) - tender action/evaluation/award.
Stage (iv) - construction.
Stage (v) - handover of works.

Suitability to pursue the professional activity:
The applicant shall declare that none of the circumstances specified in Article 54 of Directive 2004/17/EC (and Regulation 56 of SI No. 50 of 2007) or Article 45 and 51 of Directive 2004/18/EC (and Regulation 53 of SI 329 of 2006) apply.
In accordance with the criteria as set out in the document entitled, Capital Works Management Framework Questionnaire i.e. Suitability Assessment for Service Providers.
Minimum level(s) of standards:
Provide Evidence of Economic and Financial Standing Criteria - Article 54 of Directive 2004/17/EC (and Regulation 56 of SI No. 50 of 2007) and Article 47 of Directive 2004/18/EC (and Regulation 55 of SI of No. 329 of 2006).
In accordance with the criteria set out in the documant entitled, Capital Works Management Framework Questionnaire i.e. Suitability Assessment for Service Providers.
The applicant should refer to the requirements of Article 54 of Directive 2004/17/EC (and Regulation 56 of SI No. 50 of 2007) and Article 48 of Directive 2004/18/EC (and Regulation 56 and 57 of SI No. 329 of 2006).

Contract execution
Deposits and guarantees required:
Evidence must be provided of having in place professional indemnity insurance, with an indemnity limit of at least 6 500 000 EUR for each and every claim, together with the terms of the policy.
Main financing conditions and payment arrangements and/or reference to the relevant provisions governing them:
A fixed price tender proposal is required in accordance with the Department of Finance Standard Conditions of Engagement for Consulting Services (Technical).
Waterford County Council operates in accordance w ith the European Communities (Late Payment in Commercial Transactions) Regulations 2002.
Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
Prior to the award of contract any group of consultants must form a legal entity. Where a consortium of partnership or firms is proposed, a single named service provider, who shall be directly responsible for the delivery of the service shall lead the contracting parties. The parties shall be jointly and severally bound for the delivery of the service specified in the brief to be issued to the shortlisted candidates by the Contracting Authority.

It is a condition for the award of this contract that the firm selected and all its proposed sub-consultants must be able to produce a valid tax clearance certificate or C2 certificate. The consultant to whom the contract is awarded and all sub-consultants shall continue to hold valid certificates for the duration of the contract.
