Dublin City Council is subject to the Freedom of Information Act. Where Tenderers consider that any information supplied by them in response to this Notice is either commercially sensitive or confidential in nature, this should be highlighted and the reasons specified. Requests for access to such information under the Act will take into account the nature of the information. It is a condition of the award of the contract that the tenderer is able to produce promptly a currrent Tax Clearance Certificate. In the case of a non-resident Service Provider, he should be in a position to produce a statement (in lieu of a current Tax Clearance Certificate) from the Revenue Commiossioners that he has satisfied them as to his suitability on tax grounds to be awarded the contract. Suppliers must register their interest on the etenders web site in order to be included on the mailing list for clarifications. If for any reason it is not possible to award the contract to the designated successful tenderer emerging from this competitive process, or if having awarded the contract, the contracting authority considers that the successful tenderer has not met its obligations, the contracting authority reserves the right to award the contract to the next highest scoring tenderer on the basis of the terms advertised. This shall be without prejudice to the right of the contracting authority to cancel this competitive process and/or initiate a new contract award procedure at its sole discretion.
