Provision of legal service to FรS - framework agreement
Foras รiseanna Saothair (the โContracting Authorityโ), the training and employment Authority is seeking to retain the services of legal advisors.
FรS, the Training and Employment Authority was established in January 1988 under the Labour Services Act 1987. Its functions include the operation of training and employment programmes, the provision of an employment/recruitment service and an advisory and support service for business.
As and from 1.1.2011, responsibility for FรSโ employment services and community employment programmes transferred to the Department of Social Protection. It is anticipated that these functions will be fully integrated into the Department by mid 2011, including the transfer of staff and relevant assets. FรS will continue to provide these services on behalf of the department of social protection in the interim.
Description of requirements.
This competition involves the appointment of:
a. a single firm of legal advisors to provide general legal advice on an ad hoc basis, and
b. a panel of firms (a maximum of 5) of legal advisors to a framework to provide legal services for stand alone projects identified by FรS; when applicable, advisors will be commissioned on a project by project basis pursuant to a mini-tender competition (for the avoidance of doubt this panel shall include the successful tenderer at point (a))
Service providers must be in a position to demonstrate that they have sufficient resources and expertise to enable them to provide comprehensive legal advice on a range of issues in a complex environment.
The types of services to be provided include but are not limited to the following:
Provision of legal advice to the FรS board and executive in relation to all areas of applicable law, including statutory, common and public law and regulatory compliance.
Provision of legal advice in relation to the various schemes and programmes operated.
By FรS including but not limited to community employment, job initiative, community.
Training workshops, community training programme, safepass, construction skills.
Certification scheme, apprenticeship.
Handling of cases before the Employment Appeals Tribunal, the Labour Relations Commission, the Labour Court, Arbitrations and Mediations, the Equality Tribunal; handling of litigation in the District, Circuit and High Courts including a small amount of debt collection.
Provision of specialist advice including but not limited to HR/employment law, property and conveyancing, public procurement, contracts, pensions, taxation, data protection, intellectual property law, EU legislation and directives, corporate governance.
