Conditions for participation
Suitability to pursue the professional activity:

(1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.

(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.

(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.

(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.

(5) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.

(6) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law or of the relevant State in which the economic operator is established.

Economic and financial standing:

Tenderers must demonstrate that they have an overall turnover in the last 3 years of a minimum of 250 000 EUR.

Tenderers must provide the following specified documentation when requested by the Contracting Authority. However, where the Tenderer is unable, for a valid reason, to provide the specified documentation the Tenderer must inform the Contracting Authority of that valid reason as to why the documentation cannot be supplied and can provide such other suitable alternative documentation to prove, to the satisfaction of the Contracting Authority, their economic and financial capacity:

(i) bankers statement from the Tenderer’s current principal bank dated within the last 6 months; and

(ii) copy of auditor’s report for the 3 previous financial years. Where a Tenderer is trading for less than three years accounts for each year of trading must be provided.

Tenderers should note that economic operators relying on the capacity of other entities must submit an undertaking duly evidenced when requested by the Contracting Authority from those entities that they will place the necessary resources at the disposal of the Tenderer.

The documentation required will be requested by the Contracting Authority prior to (and shall be a condition of) the award of any contract.

Technical and professional ability:

All Tenderers must demonstrate that they have the level and depth of experience to provide services of a similar type to those sought herein and must furnish the following documentation with their Tenders. Tenderers will either pass OR fail these qualification criteria:

(i) the Curriculum Vitae/Resumes of all personnel who will be assigned by the Successful Tenderer to provide the Services sought in this RFT to this project. The Tenderer must provide copies of all professional qualifications of nominated personnel;

Please note that in relation to the financial advice the person nominated must be a professional qualified accountant;

(ii) a list of similar services provided in the last 3 years giving an indication of the scale of the project, dates and the services provided; and

(iii) three references (including contact names and details) for similar or related services provided in the last 3 years. The Contracting Authority may contact any or all referees without prior notice being given to the Tenderer.

Tenderers should note that economic operators relying on the capacity of other entities must submit an undertaking duly evidenced with their Tender from those entities that they will place the necessary resources at the disposal of the Tenderer.

Contract execution
Legal form to be taken by the group of economic operators to whom the contract is to be awarded:

Where a group of undertakings submit a Tender in response to this RFT the Contracting Authority will deal with all matters relating to this public procurement competition through the entity who will carry overall responsibility for the performance of the Services Contract only (“Prime Contractor”), irrespective of whether or not tasks are to be performed by a subcontractor and/ or consortium members. The Tenderer must clearly set out:

(i) the full legal name of the Prime Contractor together with its registered business address (where applicable), registered business name (where applicable), company registration number (where applicable), telephone and e-mail contact details;

(ii) the names of all sub-contractors and/ or consortium members who will be involved in the supply of the Services;

(iii) a description of the role to be fulfilled by each sub-contractor and/ or consortium member; and

(iv) the name, title, telephone number, postal address, facsimile number and e-mail address of the nominated contact personnel authorised to represent the Prime Contractor, within the organisation of the Prime Contractor, to whom all communications shall be directed and accepted until this public procurement competition has been completed or terminated. Correspondence from any other person (including from any sub-contractor and/or consortium member) will NOT be accepted, acknowledged or responded to.

Execution of the service is reserved to a particular profession: The financial advisor nominated must be a professional qualified accountant.
