N5 Ballaghaderreen Bypass Road Project - Design Build Contract

Roscommon County Council

The Contract shall comprise the Design, Execution and Completion of the N5 Ballaghaderreen Bypass Road project, including without limitation the provision of:
โ€” approximately 13.6km of standard single carriageway National Primary road,
โ€” approximately 8.6km of accommodation roads,
โ€” seven bridge structures including one river bridge, five road bridges and one accommodation structure,
โ€” realignment of regional and local roads impacted by the project including tie-in to the existing local and regional road network (total length approx. 8.8km including all tie-ins),
โ€” various accommodation Works,
โ€” various drainage Works including the provision of culverts, attenuation and treatment measures as required,
โ€” various landscape, environmental and mitigation measures,
โ€” various fencing and safety barrier Works,
โ€” various earthworks Works,
โ€” various road marking, signing and lighting Works,
โ€” various Works including diversion of the assets of various Authorities, Utilities and Services Providers; and,
โ€” various ancilllary Works.
Notwithstadning the above, the full scope of the Design, Execution and Completion of the Works and the obligations of the Contractor under the Contract shall be ascertained by reference to the Contract as a whole.

(a) Applicants are required to return Four hard copies of their complete pre-qualification submission on or before the specified closing date for receipt of submissions. The four hard copies of the submission shall comprise of 1 Master Copy with 'original' Signatures as required and 3 additional copies in which the Signatures may be copies of those Signatures contained within the Master Copy. Applicants should submit their submissions in a sealed envelope or box or series of envelopes or boxes. Each envelope or box must be clearly marked with the name of the Applicant, the name of the Contract and the copy number. For example "Pre-Qualification submission of ABC Limited for the N5 Ballaghaderreen Bypass Road Project - Design Build Contract, Copy 1 Master'. (b) The Contracting Authority is subject to the provisions of the Freedom of Information Acts. Therefore, where Applicants consider any information they provide in the course of this competition to be commercially sensitive or confidential in nature, the Contracting Authority shall be so advised and the reasons specified. The nature of the documentation may then be taken into account by the Contracting Authority in considering requests, if any, for access to such information under the Freedom of Information Acts. (c) Applicants shall bear all costs associated with the preparation and issue of their request to participate submission and, if selected to tender, their tender. The Contracting Authority shall not be responsible or liable for any costs, expenses or losses which may be incurred by the Applicant in the preparation or submission of its request to participate submission and/or tender or in relation to any interviews, presentations, clarifications or additional information associated with the evaluation of submitted requests to participate/tenders that may arise following submission, regardless of the conduct or outcome of the procurement process. (d) It is a condition of the award of this contract that the successful Applicant is able to promptly provide a valid Tax Clearance Certificate from the Revenue Commissioners in Ireland, or for a non-resident, a statement from the Revenue Commissioners in Ireland confirming suitability on tax grounds. (e) Nothing in the Pre-qualification Documentation attached to this notice is, nor shall be relied upon as, a promise or representation as to the ultimate decision of the Contracting Authority in relation to the award of the contract. However, the Contracting Authority reserves the right to take such steps as are considered appropriate, including (but not limited to): โ€” changing the basis of, or the procedures (including the timetable) relating to, the request to participate process, โ€” rejecting any, or all, of the Applicants, โ€” not inviting an Applicant to proceed further, โ€” not furnishing an Applicant with additional information, or โ€” abandoning the competition.
