Framework for replacement consultants for School Projects

Framework panels for (1) Architectural, (2) Civil Structural Engineering, (3) Building Services (M&E) Engineering, and (4) Quantity Surveying Services appointments for existing school projects where the incumbent consultant is no longer in a position to provide the service (due to death, incapacity, insolvency or any other reason) and an urgent appointment is required.
The framework panels will comprise consist of all applicants who meet both the minimum standard for participation (suitability assessment) and the minimum award criteria standard for each category of project. The project categories are Type 2a i.e. projects up to 2 500 000 EUR (estimated construction value) without particular complexity; Type 2b i.e projects up to 5 000 000 EUR or of medium complexity; and Type 3 i.e. projects above 5 000 000 EUR or having a particular complexity. The final decision on the assigned project type rests with the Contracting Authority. There will be 3 framework panels for each consultancy discipline. Any applicant qualifying for Type 3 will be automatically qualified for Type 2b and any applicant qualifying for Type 2b will be automatically qualified for Type 2a. (Thus the list for type 2a will include all consultants on the Type 2b and Type 3 panels).
The duration of the frameworks will be 2 years from the date of formation to the issue of the last secondary competition tender documents. Because the secondary appointments are for urgent replacement consultants, the number and frequency of secondary competitions cannot be predicted and no secondary competitions may be held for one or more of the above panels.

Where a substantive re-working of existing drawings and documentation is required the cost of same will be determined (prior to appointment) in accordance with Clause 11 of the Conditions of Engagement. Subject to the above review and amendment process, the consultant will be required to accept liability (appropriate to the above consultancy discipline) for all actions and Design decisions subsequent to appointment.

Before submitting an expression of interest, applicants should refer to the Suitability Assessment Questionnaire DoES-QC1 (Replacement Consultants Framework 2011) and the Tender Proposal Form (Replacement Consultants Framework 2011) attached to the eTenders advertisement, and satisfy themselves that they meet the minimum standards required. All applicants who meet both the minimum standard for participation (suitability assessment) and the minimum award criteria standard for each category of project will be included on that panel. In cases of disputed delivery the only acceptable evidence of delivery is a registered letter or signed CA receipt for hand delivery (not Swift Post). Note: The envelope must be clearly marked with the name of the Tenderer, the name of the Contract, and the content for example "Tender of ABC Limited for xxx Services for XYZ...Projectโ€. The estimated total performance period for appointment arising from a secondary competition will be specified in the relevant tender documentation but will include the remaining period for design and tender action, the construction period and a 12 months defects period. The award criteria are as stated in this notice and in the Tender Proposal Form (Replacement Consultants Framework 2011). The Contracting Authority reserves the right to terminate a secondary tender competition process at any time. The Contracting Authority also reserves the right to procure replacement consultants by alternative means if it appears that the replacement consultants can be thereby more advantageously procured. The lowest or any tender at secondary competition stage will not necessarily be accepted. The funding agency, the Department of Education & Skills is subject to the requirements of the Freedom of Information Act. Where the documentation provided does not comply, the consultant will (subsequent to consultation and agreement with the other DT members and if necessary the client) amend the documents accordingly as part of the service.
