Fingal County Council (Fingal), acting as a lead buyer on behalf of itself and Dún Laoghaire-Rathdown County Council, is engaging in a competitive process for the establishment of a multi-operator framework agreement for a project involving civil engineering works for drinking water schemes.
The framework agreement will be established on the basis of a competition for an initial contract for rehabilitation watermain works at the Rath Lane and Kileek Lane Watermain Scheme in the Fingal area.

Quantity or scope:

Framework agreement.The scope of the works required under the framework will include the execution of civil engineering works for drinking water, including but not limited to:— watermain rehabilitation and new works, including predominantly laying of new watermains, and ancillary work in upgrade works in public roadways, and— minor works at upgrading water assets such as reservoirs and pumping stations as well as replacement of services from the main up to the customer’s property,— the works will include permanent reinstatement of surfaces in all contracts.This list is not exhaustive and may also include other minor works as required by Water Services under the scope of the framework.It is envisaged that works under the framework agreement will require Specialist skills in the area of Trenchless Technology Pipe Laying Works, e.g. directional drilling, pipe bursting, pipe welding and moling of small diameter service pipes.Initial contract.The initial contract under the framework will be for the laying of a replacement watermain on the Rath Lane and Kileek Lane in the Swords electoral Area of Fingal County Council. The contract will involve the laying of 3 730 m of 125 mm PE100 SDR 13.5 (or 100 mm D.I.) watermain on the Rath Lane and also the laying of 2 300 m of 315 mm PE 100 SDR 13.5 (or 250 mm D.I.) watermain on Kileek Lane. These w/mains are to replace the existing 4”uPVC and 4”A.C. mains.The proposed route of the new w/main is on the opposite side of the road to the existing w/main. However it is also acceptable to lay the main adjacent to the old main if this is the preferred route of the appointed contractor.The watermain is to be laid in sections up to 1 000 m long, tested, made live and then the domestic and non domestic connections for the section are to be completed.

Framework agreement.

Description of options:

The contracting entity reserves the right at its sole discretion to apply the provisions of Article 40.3(g) of Directive 2004/17/EC for the award of new contracts for the repetition of similar works in conformity with the project which is the subject of this framework agreement.

A grouping, if successful, may be required to contract as a single entity having joint and several liability but subject to the agreement of the contracting parties.

If it is proposed to sub-contract the delivery of any portion of the initial contract or any subsequent contract under the framework, it will be a condition of award of contract that both the contractor and any proposed sub-contractor/specialist enter into a collateral warranty with the contracting entity for the relevant portion of that contract.

Other particular conditions:

Candidates are advised that the sucessful contractor for the initial contract will be required to sign with Fingal the Public Works Contract for Minor Building and Civil Engineering Works designed by the Employer, strictly in accordance with the format issued by the Irish Department of Finance.

The contracting entity will not conclude this framework agreement (and the reviewable contract) to which a standstill period applies in accordance with Irish Statutory Instrument SI 131 of 2010, until after the expiry of the standstill period which commences on the day following the date of notification of concerned candidates and tenderers. The duration of the standstill period will be 14 calendar days where notifications are sent electronically or by fax and 16 calendar days where these are sent by any other means.
