Framework Agreement for Building Works

Quantity or scope

The framework is for construction work and it is currently proposed that it will include approximately 12 projects varying in cost from approximately 1 500 000 EUR to 10 000 000 EUR. These projects are due to start on site between 2011 and 2015. The projects may be phased and may require co-ordination works with adjoining sites. The projects are to construct social housing or to construct buildings or to complete significant remedial work to existing houses. They will include the construction of the associated roads, utilities, services and infrastructure.The houses and buildings will be constructed up to an A3 BER standard and will include high levels of insulation, ventilation systems including demand controlled extract ventilation, a high level of air tightness, minimising thermal bridging and could include solar thermal hot water systems and flue gas heat recovery units.Some of the sites have poor ground conditions and suitable foundations have been designed. The installations of the services and utilities need to be closely co-ordinated with neighbouring sites and co-operation and co-ordination with other contractors, consultants and local authority departments will be necessary. Additional information

1) The contracting authority will not be responsible for any costs, charges or expenses incurred by candidates or tenderers.

2) The award of contract will be subject to the approval of the competent authorities.

3) This is the sole call for competition for these works.

4) Ballymun Regeneration Limited is subject to the provisions of the Freedom of Information Act (FOI) 1997, 2003. If you consider that any of the information supplied by you is either commercially sensitive or confidential in nature, this should be highlighted and the reasons for the sensitivity specified. In such cases, the relevant material, will in response to the FOI request; be examined in the light of the exemptions provided for in the Acts.

5) It will be a condition for the award of any contract by Ballymun Regeneration Limited that the successful Tenderer and all sub-contractors produce a valid Tax Clearance Certificate or C2 Certificate from the Revenue Commissioners. In the case of a non-resident Tenderer, a statement of suitability from the Revenue Commissioners will be required.

6) Without prejudice to the principle of equal treatment, the contracting authority is entitled, but not obliged, to seek clarification from candidates of any matter relevant to the selection of candidates for the tender list.

7) If for any reason it is not possible to conclude this framework agreement, or if having concluded this framework agreement, the contracting authority considers that a successful candidate has not met its obligations, the contracting authority reserves the right to remove the candidate from the framework. This shall be without prejudice to the right of the contracting authority to cancel this competitive process and/or initiate a new tendering procedure at its sole discretion.

8) Suppliers must register their interest on the etenders web site in order to be included on the mailing list for clarifications.

9) Please note in relation to all documents, that where reference is made to a particular standard, make, source, process, trademark, type or patent, that this is not to be regarded as a de facto requirement. In all such cases, it should be understood that such indications are to be treated strictly and solely for reference purposes only, to which the words "or equivalent" will always be appended.

10) Please note also that all information relating to attachments, including clarifications and changes, will be published on the Irish Government Procurement Opportunities Portal (www.etenders.gov.ie) only. Registration is free of charge. Ballymun Regeneration Limited will not accept responsibility for information relayed (or not relayed) via third parties.

11) Emailed/faxed/late tenders will not be accepted.

12) it is a requirement that all Queries inconnection with this procurement procedure must be received by the 24th June 2011 to enable a response to be circulate before the deadline for receipt of expressions of interest.

Legal form to be taken by the group of economic operators to whom the contract is to be awarded

If successful, a grouping must be prepared to contract as a single entity having joint and several liability. If it is proposed to sub-contract the delivery of any portion of the contract, it may be a conditions of award of contract that both the service provider and any proposed subcontractor enter simultaneously into a collateral warranty with the contracting authority for the relevant portion of the contract.
